The following constitutes violations subject to criminal penalties:
(a) No person shall smoke in any area or building where smoking is prohibited;
(b) No person who owns, manages, operates or otherwise controls the use of any business or premises subject to the regulations under this chapter shall fail to comply with any of the provisions of this chapter;
(c) Any person who violates any provision of this chapter, shall be guilty of a misdemeanor of the fourth degree. Each day the violation continues shall constitute a separate offense.
