523.05 REGULATION OF SMOKING IN PLACES OF EMPLOYMENT.
   (a)   Employers shall provide a smoke free place of employment for all employees.
   (b)   Employers must have a disciplinary policy or other sanctions for violation of this chapter.
   (c)   On or before April 1, every employer maintaining a place of employment within the City of Wauseon shall adopt, implement, make known and maintain a smoking policy. The policy shall state, at a minimum:
      (1)   Smoking is prohibited in all work areas including, but not limited to, common work areas, auditoriums, classrooms, conference and meeting rooms, private offices, elevators, hallways, lobbies, medical facilities, cafeterias, employee lounges, stairs, restrooms, and other enclosed facilities.
      (2)   Employees who violate this policy are subject to disciplinary action up to and including termination and/or other sanctions.
   (d)   Employers are responsible for the notification and full disclosure of this non- smoking policy to all current and prospective employees.
   (e)   The Sponsor of any event open to the public which takes place in a private club or enclosed area shall have the same responsibilities as an employer as set forth herein.
   (f)   These provisions shall not apply to those exceptions listed in Section 523.06.
