521.085 STORAGE OF GARBAGE.
   (a)   The definition of "rubbish" and "garbage" shall be the same as set forth in Chapter 1308 .
 
   (b)   Every occupant of a structure or part thereof shall dispose of all rubbish in a clean and sanitary manner by placing it in an approved container.
 
   (c)   Every occupant of a structure or part thereof shall dispose of all garbage in a clean and sanitary manner by placing it in a garbage disposal facility or if such facilities are not available, by securely wrapping such garbage and placing it in an approved container.
 
   (d)   Every dwelling unit shall be supplied with an approved garbage disposal facility which shall be any adequate mechanical food waste grinder in each dwelling unit or an approved outside container. Such facility shall be sufficient to meet the needs of the occupants.
 
   (e)   Each dwelling unit shall be supplied with approved containers and covers for storage of rubbish and the occupant thereof shall be responsible for the removal of such rubbish.
 
   (f)   (1)   An approved rubbish or garbage container shall be a leak-proof container with close fitting covers for the storage of such material until removed from the premises for disposal, which shall be essentially impermeable to rodents or other vermin.
      (2)   A plastic garbage bag shall be considered an approved rubbish or garbage container if used to store garbage within twenty-four hours proceeding the regularly scheduled refuse pickup for the property in question.
   (g)   (1)   Any person failing to dispose of their rubbish or garbage in the manner set forth herein shall be guilty of a minor misdemeanor and subject to a one hundred dollar ($100.00) fine. Each day that a violation continues shall constitute a separate offense.
      (2)   In the event a person is convicted or has been convicted of a previous offense within two years proceeding the date upon which the criminal complaint is filed, a violation of this section shall be a misdemeanor of the fourth degree, punishable by a fine not to exceed two hundred fifty dollars ($250.00) and/or thirty days of incarceration.
