AN ORDINANCE OF THE MAYOR AND BOARD OF CITY COMMISSIONERS OF THE CITY OF WAURIKA, JEFFERSON COUNTY, STATE OF OKLAHOMA, AMENDING THE CODE OF ORDINANCES OF THE CITY OF WAURIKA, TITLE 2 BOARDS AND COMMISSIONS, CHAPTER 1 DEPOT PRESERVATION ADVISORY BOARD AND RENAMING CHAPTER 1 HISTORICAL PRESERVATION ADVISORY BOARD, AMENDING SECTION 2-1-1 TO REMOVE HONORARY NONVOTING MEMBERS; AMENDING SECTION 2-1-4 TO PROVIDE THAT THE BOARD MAY MAKE RECOMMENDATIONS ON RULES AND RGULATIONS TO THE CITY COMMISSIONS; AMENDING SECTION 2-1-5 TO PROVIDE THAT REGULAR MEETINGS SHALL BE HELD AT CITY HALL; AMENDING SECTION 2-1-6 TO PROVIDE THAT THE CITY ATTORNEY SHALL SERVE AS EX OFFICIO LEGAL COUNSEL FOR SAID BOARD. AMENDING SECTION 2-1-7 A TO PROVIDE THAT THE BOARD SHALL ASSIST WITH THE COORDINATION OF ACTIVITIES RELATED TO THE RELEVANT CITY ASSETS AS REQUESTED BY THE CITY MANAGER; AMENDING SECTION 2-1-7 F TO REMOVE THE PROHIBITION THAT THE CITY COMMISSION MAY NOT AUTHORIZE EXPENDITURES WITHOUT NOTIFICATION TO THE BOARD; AMENDING SECTION 2-1-7 G TO REMOVE THE REQUIREMENT THAT THE BOARD MUST PROVIDE A WRITTEN RECOMMENDATION PRIOR TO ACTION BY THE PLANNING COMMISSION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY THEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND BOARD OF CITY COMMISSIONERS OF THE CITY OF WAURIKA, OKLAHOMA:
 
SECTION I .      Title 2 Boards and Commissions, Chapter 1 shall be renamed Historical Preservation Advisory Board.
 
SECTION II .      Title 2 Boards and Commissions, Chapter 1, Section 2-1-1 shall be amended and shall hereinafter read as follows:
2-1-1: APPOINTMENT; TERMS:
   A.   Board Created: There is hereby created the Historical Preservation Advisory Board to be composed of nine (9) citizens who are qualified electors of the City.
   B.   Appointment; Terms: Board members shall be appointed by the Mayor and confirmed by the City Commission; the members first appointed shall serve for terms of one, two (2), and three (3) years, to be designated by the Mayor in groups of three (3), and thereafter upon the expiration of their respective terms, their successors shall be appointed for terms of three (3) years.
SECTION III .   Title 2 Boards and Commissions, Chapter 1, Section 2-1-4 shall be amended and shall hereinafter read as follows:
2-1-4: OPERATING RULES AND REGULATIONS:
The Board may recommend operating rules and regulations as are necessary and expedient for the proper operation and management of properties and facilities that are listed on the Oklahoma National Register of Historical Places (hereinafter referred to as “Historical Registry”), and shall propose alterations, changes or amendments to such rules and regulations to the City Commission for consideration; provided, that regulations established by resolution or ordinance may only be amended by resolution or ordinance. Five (5) voting members shall constitute a quorum.
SECTION IV .   Title 2 Boards and Commissions, Chapter 1, Section 2-1-5 shall be amended and shall hereinafter read as follows:
2-1-5: MEETINGS:
The board shall schedule at least eleven (11) regular meetings each year, which regular meeting shall be held at City Hall, the date and time of which shall be determined by said board, but other meetings may be held at any time or place upon the call of the Chairman of the board, the City Manager, or the Mayor, consistent with the requirements of the State Open Meetings Act.
SECTION V .   Title 2 Boards and Commissions, Chapter 1, Section 2-1-6 shall be amended and shall hereinafter read as follows:
2-1-6: OFFICERS; LEGAL COUNSEL:
   A.   Officers: The board shall elect annually from its voting members, a Chairman and Vice Chairman, and shall also appoint a Secretary who may, but need not be, a voting member of said board.
   B.   Legal Counsel: The City Attorney shall serve as ex officio legal counsel for said board.
SECTION VI .   Title 2 Boards and Commissions, Chapter 1, Section 2-1-7 A shall be amended and shall hereinafter read as follows:
   A.   Assist, as requested by the City Manager with the coordination of the operations conducted within properties and facilities on the Historical Registry, and with all other public, private and nonprofit boards or entities relating to said operations.
SECTION VII .   Title 2 Boards and Commissions, Chapter 1, Section 2-1-7 F shall be amended and shall hereinafter read as follows:
   F.   Monitor the status of the Municipal Capital Improvement Fund created for any properties and facilities on the Historical Registry, and provide specific recommendations for expenditures therefrom. The board may also sponsor or cosponsor, approve of, or conduct appropriate and legal types of fund raising activities for properties and facilities on the Historical Registry.
SECTION VIII .   Title 2 Boards and Commissions, Chapter 1, Section 2-1-7 G shall be amended and shall hereinafter read as follows:
   G.   Coordinate in the planning of, or initiate the planning of, all programs, activities or efforts relating to the depot, particularly those which involve beautification, development or rezoning of surrounding areas, road improvements adjacent to or affecting the depot, recreational area development, or any type of increased interaction with the area's neighborhoods or the City's Central Business District; in the investigation, review and consideration of all planning, zoning and development activities which affect properties and facilities on the Historical Registry
SECTION IX.    That the remaining portions of Title 2, Chapter 1 shall be unchanged by this ordinance.
 
SECTION X.       Repealer    All ordinances or parts thereof which are inconsistent with this ordinance are repealed upon effective date of this ordinance.
 
SECTION XI.     Severability.    If any section, sub-section, sentence, clause, phrase or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, said portion shall be deemed a separate, distinct and independent provision and such holdings shall not affect the validity of the remaining portions of this Ordinance.
 
SECTION XII.     Emergency.   It being immediately necessary for the preservation of the public, health, peace and safety of the City of Waurika and the inhabitants thereof, an emergency is hereby declared to exist by reason whereof this Ordinance shall be in full force and effect immediately from and after its passage, approval, and publication as provided by law.
