ORDINANCE NO. 01092023-01
AN ORDINANCE OF THE MAYOR AND BOARD OF CITY COMMISSIONERS OF THE CITY OF WAURIKA, JEFFERSON COUNTY, STATE OF OKLAHOMA, AMENDING TITLE 7 MOTOR VEHICLES AND TRAFFIC, CHAPTER 7 VEHICLE IMPOUNDMENT OF THE CODE OF ORDINANCES TO CREATE A NEW SECTION 7-7-8 “SERVICE IMPOUND FEE” TO PROVIDE FOR A SERVICE FEE IN AN AMOUNT TO BE SET FORTH BY RESOLUTION ON ALL VEHICLES IMPOUNDED PURSUANT TO MUNICIPAL CODE, STATE LAW, TRIBAL CODE, AND FEDERAL LAW; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
 
BE IT ORDAINED BY THE MAYOR AND BOARD OF CITY COMMISSIONERS OF THE CITY OF WAURIKA, OKLAHOMA:
 
SECTION I.  That a new Section of the Code of Ordinances of the City of Waurika, to be codified as Title 7, Motor Vehicles and Traffic, Chapter 7, Vehicle Impoundment, Section 7-7-8, Service Impound Fee , is hereby added and shall hereinafter read as follows:
 
Section 7-7-8: Service Impound Fee.
 
Any vehicle impounded pursuant to municipal ordinances and/or violations of state law, tribal code and/or federal law shall be subject to a service impound fee. The service impound fee amount shall be set forth by Resolution.
 
and that the remainder of Title 7, Motor Vehicles and Traffic, Chapter 7, Vehicle Impoundment, shall remain unchanged by this Ordinance.
 
SECTION II.  Repealer.  All ordinances or parts thereof which are inconsistent with this Ordinance are repealed upon the effective date of this Ordinance.   
 
SECTION III.  Severability. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the remaining portions of this Ordinance.
 
SECTION IV.  Emergency. It being immediately necessary for the preservation of the public, health, peace and safety of the City of Waurika and the inhabitants thereof, an emergency is hereby declared to exist by reason whereof this Ordinance shall be in full force and effect immediately from and after its passage, approval, and publication as provided by law.
