8-3-1: RULES AND REGULATIONS:
   A.   Hours: The park and recreational areas and facilities owned and operated by the City shall be closed to the public from one o'clock (1:00) A.M. of each night until six o'clock (6:00) A.M. of the following day, and it shall be unlawful for any person to remain in or upon said areas or facilities between said hours for any purpose.
   B.   Motor Vehicles: It shall be unlawful for any motor vehicles to be used in or upon said park areas or facilities, except in those areas designated (by markings or signs) as roadways, driveways or parking areas, within said park areas or facilities.
   C.   Damage Or Destruction of City Equipment Or Property: It shall be unlawful for any person or group of persons to damage, remove, deface or destroy any equipment or property owned by the City located within said park areas or facilities.
   D.   Overnight Camping Prohibited: The City's public park areas may not be used for overnight camping purposes by any person, firm or corporation, whether a resident or a nonresident of the City.
   E.   Use Agreement: Any individual or organization seeking to use city property for a public or private activity must apply at the office of the City Clerk at least thirty (30) days prior to the date of the planned event. The City Manager shall prepare an agreement for the use of the city property, which shall include reasonable rules and regulations and provide that the individual or organization shall indemnify and hold the city harmless from all damages, claims and demands of any person by reason of the operations and conduct of the individual or organization on city property. The City Manager is hereby authorized to sign the agreement and both the City Manager and the individual or authorized representative of the organization must sip the agreement prior to the planned event. If the City Manager refuses to authorize the event, the individual or organization may appeal that decision to the Board of City Commissioners.
   F.   Use Fee. The Board of City Commissioners shall adopt a fee schedule by resolution for the use of city property. (2007 Code § 16-100; amd. Ord. 04112022-08, 4-11-2022)
