4-3-1: DEFINITIONS:
The following terms are defined as set forth for use in this chapter:
BUSINESS LICENSE:
A current and valid business license for a medical marijuana dispensary, commercial grower, marijuana processor, marijuana laboratory, marijuana educational facility or marijuana testing facility issued under this chapter, which shall be granted to a business license holder only for and limited to a specific permitted premises and specific permitted property.
BUSINESS LICENSE HOLDER:
The person that holds a current and valid business license issued under this chapter.
CAREGIVER:
A person that has been issued a medical marijuana license pursuant to 63 Oklahoma Statutes sections 420 et seq., as promulgated through the Oklahoma Medical Marijuana Authority, or successor agency, section 310:681-1-1, chapter 681 et. seq., as amended from time to time.
COMMERCIAL GROWER:
An entity that is licensed by the Oklahoma State Department of Health pursuant to 63 Oklahoma Statutes section 422, which allows the entity to grow, harvest, and dry medical marijuana for the purpose of selling medical marijuana to a dispensary, processor, or researcher.
COMMERCIAL WASTE DISPOSAL LICENSE:
A license issued to a medical marijuana waste disposal entity.
MARIJUANA PROCESSOR:
An entity that is licensed by the Oklahoma State Department of Health pursuant to 63 Oklahoma Statutes section 423 which allows the entity to purchase marijuana from a commercial grower; prepare, manufacture, package, sell to and deliver medical marijuana products to a dispensary licensee or other processor licensee; and may process marijuana received from a qualified patient into a medical marijuana concentrate, for a fee.
MEDICAL MARIJUANA DISPENSARY:
An entity that is licensed by the Oklahoma State Department of Health pursuant to 63 Oklahoma Statutes section 421 which allows the entity to purchase medical marijuana from a commercial grower or processor and sell medical marijuana only to qualified patients and caregivers.
MEDICAL MARIJUANA EDUCATION FACILITY:
An entity that is licensed by the Oklahoma State Department of Health pursuant to 63 Oklahoma Statutes section 427.20 which allows a person to possess or cultivate marijuana for limited education and research purposes identified by law.
MEDICAL MARIJUANA ESTABLISHMENT:
A medical marijuana dispensary, medical marijuana commercial grower, medical marijuana processor, medical marijuana laboratory testing facility, medical marijuana education facility, medical marijuana research facility, or medical marijuana waste disposal facility, all of which are established by law.
MEDICAL MARIJUANA ESTABLISHMENT BUSINESS LICENSE:
The business license from the City for a medical marijuana dispensary, medical marijuana commercial grower, medical marijuana processor, medical marijuana laboratory testing facility, medical marijuana education facility, medical marijuana research facility, or medical marijuana waste disposal facility, all of which are established by law.
MEDICAL MARIJUANA RESEARCH FACILITY:
An entity that is licensed by the Oklahoma State Department of Health pursuant to 63 Oklahoma Statutes section 427.19 which allows a person to possess or cultivate marijuana for limited research purposes identified by law.
MEDICAL MARIJUANA TESTING FACILITY:
An entity that is licensed by the Oklahoma State Department of Health pursuant to 63 Oklahoma Statutes section 427.17 which allows a person to possess medical marijuana for the purpose of conducting mandatory testing that is required by law.
MEDICAL MARIJUANA WASTE DISPOSAL LICENSE:
A license issued by the Oklahoma State Department of Health pursuant to the Oklahoma Medical Marijuana Waste Management Act set forth in 63 Oklahoma Statutes sections 427a et. seq.
PERMITTED PREMISES:
The particular building or buildings within which the business license holder will be authorized to conduct the facility's activities pursuant to the business license. Permitted property means the real property comprised of a lot, parcel, or other designated unit of real property upon which the permitted premises is situated.
PERSON:
As used herein includes a business entity whether corporation, limited liability company, partnership, or otherwise.
STRUCTURE:
An enclosed building with walls that is affixed to the ground.
QUALIFIED PATIENT:
A person that has been issued a medical marijuana license pursuant to 63 Oklahoma Statutes sections 420 et seq. (Ord. 05112020-04, 5-11-2020; amd. Ord. 11082021-11, 11-8-2021)
