12-2-3: DEFINITIONS:
The following words and terms, when used in this title, shall have the meanings ascribed to them in this section:
ACCESSORY BUILDING: Any building that is: (a) is subordinate in extent and purpose to the principal building; (b) is customarily found as an incident to such principal building; (c) contributes to the comfort, convenience, or necessity of those occupying, working at, or being served by the principal building; (d) is located on the same lot as the principal building; and (e) is under the same ownership and control as the principal building.
ADULT-USE CANNABIS CRAFT GROWER: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to cultivate, dry, cure and package cannabis and perform other necessary activities to make cannabis available for sale at an adult-use dispensing organization or use at an adult-use processing organization, per the Cannabis Regulation and Tax Act, as amended, and regulations promulgated thereunder.
ADULT-USE CANNABIS CULTIVATION CENTER: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to cultivate, process, transport and perform necessary activities to provide cannabis and cannabis-infused products to licensed adult-use cannabis business establishments, per the Cannabis Regulation and Tax Act, as amended, and regulations promulgated thereunder.
ADULT-USE CANNABIS DISPENSING ORGANIZATION: A facility operated by an organization or business that is licensed by the Illinois Department of Financial and Professional Regulation to acquire cannabis from licensed cannabis business establishments for the purpose of selling or dispensing cannabis, cannabis-infused products, cannabis seeds, paraphernalia or related supplies to adult-use purchasers, per the Cannabis Regulation and Tax Act, as amended, and regulations promulgated thereunder.
ADULT-USE CANNABIS ORGANIZATION: An adult-use cannabis cultivation center, adult-use cannabis craft grower, adult-use cannabis processing organization, adult-use cannabis infuser organization, adult-use cannabis dispensing organization or adult-use cannabis transporting organization.
ADULT-USE CANNABIS INDUSTRIAL ORGANIZATION: An adult-use cannabis cultivation center, adult-use cannabis craft grower, adult-use cannabis processing organization, adult-use cannabis infuser organization or adult-use cannabis transporting organization.
ADULT-USE CANNABIS INFUSER ORGANIZATION: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to directly incorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis-infused product, per the Cannabis Regulation and Tax Act, as amended, and regulations promulgated thereunder.
ADULT-USE CANNABIS PROCESSING ORGANIZATION OR PROCESSOR: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to either extract constituent chemicals or compounds to produce cannabis concentrate or incorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis product, per the Cannabis Regulation and Tax Act, as it may be amended from time to time, and regulations promulgated thereunder.
ADULT-USE CANNABIS TRANSPORTATION ORGANIZATION: An organization or business that is licensed by the Illinois Department of Agriculture to transport cannabis on behalf of an adult-use cannabis business establishment or a community college licensed under the Community College Cannabis Vocational Training Pilot Program, per the Cannabis Regulation and Tax Act, as amended, and regulations promulgated thereunder.
ALLEY: A secondary thoroughfare, less than thirty feet (30') in width, dedicated for the public use of vehicles and pedestrians affording access to abutting property.
APARTMENT: One or more rooms comprising a dwelling unit or serving as the home or residence of an individual, or a family or a household.
AREA OF BUILDING: The horizontal projected floor area inside of exterior enclosure walls or between exterior walls and fire walls.
BASEMENT: A story of a building having more than one-half (½) its height below the level of the average height of the finished grade at the middle of the front of the building. Synonymous with "cellar".
BUILDING: A structure enclosed within exterior walls or fire walls, built, erected and framed of component structural parts, designed for the housing, shelter, enclosure and support of individuals, animals or property.
BUILDING OFFICIAL: The officer or other designated authority charged with the administration and enforcement of this title, or his duly authorized representative.
CANNABIS DISPENSING ORGANIZATION: Any adult-use cannabis dispensing organization or medical cannabis dispensing organization.
CANNABIS INDUSTRIAL ORGANIZATION: Any facility operated by an adult-use cannabis cultivation center, adult-use cannabis craft grower, adult-use cannabis processing organization, adult-use cannabis infuser organization, adult-use cannabis transporting organization, medical cannabis cultivation center, medical cannabis craft grower, medical cannabis processing organization, medical cannabis infuser organization or medical cannabis transporting organization.
CANNABIS ORGANIZATION: Any adult-use cannabis organization or medical cannabis organization.
DISTRICT: A territory delineated on the Zoning Map for which the regulations and restrictions of this title governing the use of land and buildings, the height of buildings, the bulk of buildings, the floor area, the open space, the size and location of yards, and the off-street parking facilities are uniform.
DWELLING UNIT: One or more rooms arranged for the use of one or more individuals living together as a single housekeeping unit, with cooking, living, sanitary and sleeping facilities.
FAMILY: A person living alone, or two (2) or more persons living together as a single housekeeping unit in a dwelling unit, but not more than ten (10) persons unrelated to each other by blood, marriage, or legal adoption.
GARAGE, PRIVATE: An accessory building designed for the storage of an automobile or automobiles belonging to the occupants of a specified dwelling or apartment. This term shall also include "carport".
HEIGHT, BUILDING: The vertical distance from the grade to the top of the highest roof beams of a flat roof, or to the main level of the highest gable or slope of a hip roof. When a building faces on more than one street, the height shall be measured from the average of the grades at the center of each street front.
HOME OCCUPATION: A gainful occupation or profession customarily carried on by an occupant of a dwelling unit as a use which is clearly incidental to the use of the dwelling unit for residential purposes. The home occupation shall be carried on wholly within the principal building or within a building accessory thereto, and only by members of the family occupying the premises and one person outside the family. There shall be no exterior display, no exterior storage of materials, no other exterior indication of the home occupation or variation from the residential character of the principal building, and no offensive odors, noise, vibration, smoke, dust, heat or glare shall be produced. Grocery stores, tearooms, restaurants, dress shops, millinery shops, tourist homes, animal hospitals and kennels, among others, shall not be deemed to be home occupations.
INTERIOR LOT LINE: Any lot line other than one adjoining a street or public space.
LINE OF BUILDING (For Measuring Yards): A line parallel to the nearest lot line drawn through the point of the exterior side of the base of a building or group of buildings nearest to such lot line, exclusive of such features or obstructions specified as being permitted to extend into a yard.
LOT LINE, FRONT: The line dividing a lot from a street. On a corner lot, only one street line shall be considered as a front; provided, that where the length of a shorter line is less than eighty percent (80%) of the length of the longer line, the shorter street line shall be considered as the front.
LOT LINE, REAR: The lot line opposite the front lot line. In the case of an irregular, triangular or gore- shaped lot, it shall mean a line within the lot, ten feet (10') long, parallel to and at the maximum distance from the front lot line.
LOT LINE, SIDE: Any lot line other than a front or rear lot line. A side lot line separating a lot from a street shall be called a “side street line”. A side lot line separating a lot from another lot or lots shall be called an “interior side lot line”.
MEDICAL CANNABIS CULTIVATION CENTER: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to cultivate, process, transport and perform necessary activities to provide cannabis and cannabis-infused products to licensed medical cannabis dispensing organizations, per the Compassionate Use of Medical Cannabis Program Act, as it may be amended from time to time, and regulations promulgated thereunder.
MEDICAL CANNABIS DISPENSING ORGANIZATION: A facility operated by an organization or business that is licensed by the Illinois Department of Financial and Professional Regulation to acquire cannabis from licensed cannabis business establishments for the purpose of selling or dispensing cannabis, cannabis-infused products, cannabis seeds, paraphernalia or related supplies to registered qualifying patients, per the Compassionate Use of Medical Cannabis Program Act, as it may be amended from time to time, and regulations promulgated thereunder.
MEDICAL CANNABIS ORGANIZATION: A medical cannabis cultivation center, medical cannabis processing organization, medical cannabis infuser organization, medical cannabis dispensing organization or medical cannabis transporting organization.
MEDICAL CANNABIS INDUSTRIAL ORGANIZATION: A medical cannabis cultivation center, medical cannabis processing organization, medical cannabis infuser organization or medical cannabis transporting organization.
MEDICAL CANNABIS INFUSER ORGANIZATION: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to directly incorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis-infused product, per the Compassionate Use of Medical Cannabis Program Act, as amended, and regulations promulgated thereunder.
MEDICAL CANNABIS PROCESSING ORGANIZATION: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to either extract constituent chemicals or compounds to produce cannabis concentrate or incorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis product, per the Compassionate Use of Medical Cannabis Program Act, as amended, and regulations promulgated thereunder.
MEDICAL CANNABIS TRANSPORTING ORGANIZATION: An organization or business that is licensed by the Illinois Department of Agriculture to transport cannabis on behalf of a medical cannabis business establishment, per the Compassionate Use of Medical Cannabis Program Act, as it may be amended from time to time, and regulations promulgated thereunder.
MULTI-FAMILY APARTMENT HOUSE: A building containing more than two (2) dwelling units.
OPEN SPACE: A usable yard, court, or space between buildings, which is open to the sky.
PRINCIPAL BUILDING: The building on a lot intended to be utilized for the principal use and to which any other building or structure on such lot must be accessory.
SINGLE-FAMILY DWELLING: A building containing one dwelling unit. Whenever the term “single- family dwelling”, “two-family dwelling”, or “multi-family dwelling” are used in this title, all mobile homes, as described in chapter 7 of this title, are excluded from and are herein defined as not being a single-family dwelling, two-family dwelling or multi-family dwelling.
SITE LINE: Where more than one side of a lot faces on a street, the setback line on those parts of the lot facing on a street must equal the front yard setback line for that district.
TWO-FAMILY DWELLING: A building containing two (2) dwelling units.
