7-3-1: DEFINITIONS:
For the purpose of this chapter, the following definitions shall apply:
LEGAL GUARDIAN: A person appointed guardian, or given custody of a minor child by a court, but the term does not include a person appointed guardian or given custody of a minor under the “Juvenile Court Act (705 ILCS 405/1-1 et seq.)”, as amended.
MALICE: Shall be deemed to exist even where the evidence only constructively or impliedly shows malice. If it is shown that an act was wilfully done and its necessary result is to injure the property of another, malice on the part of the accused will be presumed without further evidence.
MINOR: A person who is at least eleven (11) years of age but who has not yet reached eighteen (18) years of age.
PARENT: Includes the lawful mother or father of an unemancipated minor, whether by birth or adoption.
PERSON: The City, or any individual, firm, partnership, association, corporation, company, government unit, government agency or organization of any kind.
PROPERTY: Includes any real estate, including improvements thereon, and tangible personalty.
VANDALISM:
   A.   The wilful or malicious damaging or defacing, within the corporate limits of the City, of another person’s real or personal property, without the other person's consent; or
   B.   The wilful or malicious entry into or the obtaining control over any motor vehicle, bicycle, aircraft or watercraft of another person, without the other person’s consent.
   C.   All acts which, under the common law, would be considered to be acts of malicious mischief.
