A. Violation: Any person, corporation, partnership, association or other entity who violates any section of this chapter shall be fined as provided herein. Each day that a violation occurs or is permitted to continue shall constitute a separate and distinct offense.
B. Penalties:
1. Any person who smokes in an area where smoking is prohibited under this chapter shall be fined in an amount that is not less than one hundred dollars ($100.00) for the first offense and not more than two hundred fifty dollars ($250.00) for each subsequent offense.
2. Any person, corporation, partnership, association or other entity who owns, operates, or otherwise controls a public place, place of employment, or outdoor venue that violates any provision of this chapter shall be fined: a) not less than two hundred fifty dollars ($250.00) for the first violation; b) not less than five hundred dollars ($500.00) for the second violation within one year after the first violation; and c) not less than two thousand five hundred dollars ($2,500.00) for each additional violation within one year after the first violation.
C. Administration Of Citations: Citations issued for violating this chapter may be administered through title 1, chapter 4, article A of this Code.
