(a) Every owner of a lot or parcel of land in the Municipality shall maintain the public right of way adjoining such lot or parcel in a neatly trimmed manner. The ground cover vegetation shall be considered to be neatly trimmed if it is cut at least monthly during the growing season.
(b) Upon receiving information that a property owner has not complied with subsection (a) herein, the Director of Public Works shall take the following actions:
(1) Cause notice to be sent to the owner of the property adjoining the public right of way where the ground cover vegetation has not been trimmed that such ground cover vegetation must be trimmed within five days after the date of such notice. The notice shall be sent to the address of the owner as it appears on the current tax list of the Lucas County Auditor or the mailing list of the Lucas County Treasurer.
(2) Cause such ground cover vegetation to be trimmed if the owner of the property adjoining the public right of way fails to comply with the notice referred to in subsection (b) (1) herein. The cost and expense thereof shall be billed to said property owner and if not paid within a reasonable time, shall, when approved by Council, be assessed against such adjoining lands and certified and collected as provided by law in the case of other assessments levied by Council. The expense assessed shall include all costs associated with levying and collecting such assessments. All expenses and costs assessed pursuant to this section shall be in addition to any penalty provided for in Section 927.99.
