Council hereby desires to adopt and provide for the enforcement of the Lucas County Building Code, in addition to the Ohio Basic Building Code, and the Waterville Building Code with provisions that in cases where the codes may be in conflict that the most restrictive application shall apply. Therefore, the Council finds it necessary to amend certain sections of the Lucas County Building Code.
(a) Section 102, paragraph 1, is hereby amended in full so as to read as follows:
(1) Matter covered. The provisions of this code shall apply to the erection, construction, alteration, repair, equipment, use and occupancy location, maintenance, removal, and demolition of buildings and structures in the incorporated portions of Waterville and all reasonable rules and regulations adopted in furtherance thereof and in conformity therewith.
(b) Section 102, paragraph 5, shall be amended in its entirety so as to read:
A. These provisions of this code, in addition to the Waterville Building Code and the Ohio Basic Building Code shall apply to all buildings or structures on land or over water or any place within the corporate limits of Waterville except as provided in paragraph C.
B. Such provisions shall apply with equal force to county, state, or municipal buildings as they do to private buildings except as may be specifically provided for by statutes or ordinance.
C. Such provisions shall not apply to temporary accessory buildings that do not have permanent foundations and are less than 150 total square feet and provided that such accessory buildings are not affixed or added to another structure or building which is governed by the provisions of this code and provided that, such accessory building is not to be inhabited by any person or persons.
(c) Section 102, paragraph 6 C, be hereby amended in full so as to read:
C. In the event of a conflict between the administrative provisions of the Waterville Building Code, the Ohio Basic Building Code, and this code and any subsequent ordinance pertaining thereto, the provisions of the most restrictive code shall govern and control.
(d) Whoever violates any of the provisions of the Waterville Building Code, the Lucas County Building Code, or the Ohio Basic Building Code shall be subject to any of the penalties provided therein which are specifically hereby adopted and made a part of this chapter.

(e) In order to regulate the erection, construction, repair, alteration and maintenance of residential dwellings, the Residential Code of Ohio for One-, Two-, and Three- Family Dwellings as adopted by the Ohio Board of Building Standards pursuant to Ohio R.C. 3781.10, shall apply and be enforced within the Municipality.
