935.99  PENALTY.
   (a)   Any person who violates any provision of this chapter shall be punished by a fine of not more than five hundred dollars ($500.00) or imprisonment not to exceed 90 days, or both such fine and imprisonment at the discretion of the court.  Each day such violation continues shall be considered a separate offense.
   (b)   No statement contained herein shall be construed as preventing any special agreement or arrangement between the Municipality and any user whereby wastewater with prohibited or restricted constituents may be accepted for treatment with charges proportional to the cost of the service provided. Any and all such agreements are not to be contrary to any state or federal law, regulation, or limitation.
   (c)   In a case where a violation of this chapter exists on premises that are connected to the sewer system, and said violation is continuous in nature, the Municipal Administrator shall be authorized to terminate sewer service to said premises if the violation is not corrected within 30 days after written notice to the owner or owners of said premises, as shown on the current Assessor's Records of the Municipality. The notice shall describe the violation and include notification that service will be terminated at a date certain, which shall be not less than 30 days from the date the notice is mailed, if it is mailed, or the date it is delivered to the property owner or owners, if notice is given in this manner. The notice may be mailed to the owner by certified mail, return receipt requested, or may be delivered personally to the owner or left at the owner's usual place of abode with a person of suitable age and discretion. After service has been terminated in accordance with this section, it shall be restored by the Municipality as soon as practicable after the correction of the violation. In cases where service is terminated under this section, the cost of the termination and restoration of service shall be charged to and paid by the property owner, and may be billed and collected, or assessed against the premises served, in the same manner as service charges provided for herein.
   (d)   The Administrator shall have the right to terminate sewer service immediately if it is determined that the violation produces a dangerous, toxic, odorous, destructive, or other condition which, in the opinion of the Administrator, cannot be tolerated.
