(a) Commencing on or after March 17, 1977, there is levied and assessed on each lot, parcel of land, building, or premises having any sewer connection with the sanitary sewer system of the Municipality or otherwise discharging sewage, industrial wastes, water, or other liquids either directly or indirectly into the wastewater treatment system, a charge for use of the system.
(b) The users of the system shall be divided into classes. Classes shall be groups of users for which the wastewater characteristics are approximately equal and services provided are essentially the same. Initially there shall be established two classes of users, as follows:
(1) Industrial users.
(2) Nonindustrial users. All dischargers to the system not described in (b) (1) above.
(3) The user charges shall result in the distribution of operation, maintenance, and replacement costs of the treatment works within the jurisdiction of the Municipality to each user class in proportion to such user's contribution of the total wastewater loading of the treatment works. Factors such as strength, volume, and delivery flow rate characteristics shall be included to ensure a proportional distribution of the costs.
(c) The Municipal Administrator may establish additional classes as determined to be necessary.
(d) Charges for wastewater treatment service shall be paid by each user connected or required to be connected to the system, and shall be computed in accordance with the probable demand a user places on the system and the quantity of water discharged to the system as measured by the municipal water meter installation thereon or by a sewage meter installed on the discharge pipe therefrom, or as estimated by the Municipality.
(e) When a considerable amount of water delivered to any premises is not returned to the municipal sewage disposal system, the Administrator in such case may establish a special basis on which the sewage disposal charges to such premises will be computed, or, on a determination by either the Administrator or the customer that the use of direct metering of sanitary sewage flow is necessary or is a more equitable method of determining sewage disposal charges, the Administrator shall order the installation of wastewater meters.

(f) (1) There is hereby established a rate structure for sanitary sewer service to all customers through the Municipality of Waterville Sanitary Sewer Collection System. Said rates shall be charged and levied on affected real property in the Municipality and defined through the following two categories:
A. Consumption Charge. Rate charged each month to all customers for each 1,000 gallons of water used by said customer. Charges indicated for each year are effective with the bills rendered on and after January 1, of said year except as otherwise specified.
B. Capital Charge. An equal, uniform rate paid each month by all customers for capital improvements to the City sewer system and for debt service generated by capital improvements to the City sewer system. Charges indicated for each year are effective with the bills rendered on and after January 1 of said year except as otherwise specified.
(2) Consumption charge.

(4) Said rates as defined herein are hereby established with the expressed purpose of creating and providing adequate revenue to support all costs associated with the operation of the Municipality’s Sanitary Sewer System, including but not limited to, personnel, supplies, maintenance, debt service, capital improvements, and duly authorized contractual debt service commitments.
(5) Said rates as defined herein shall be analyzed and reviewed annually by the municipal staff, Finance Committee and Council within the budget development process to determine their adequacy for supporting all necessary expenditures relating to the Municipal Sanitary Sewer System.
(6) The capital charge as described in this section shall automatically increase or decrease in increments that are equivalent in terms of percentage to any increase or decrease in rates and/or debt service charged by Lucas County for services provided through the Maumee River Wastewater Treatment Plant.

(g) High strength surcharges. In addition to the minimum charge and the commodity charge given above, any user discharging wastewater containing B.O.D. in excess 180 mg/l (or C.O.D. in excess of 450 mg/l), suspended solids of 200 mg/l, or phosphorus in excess of 19 mg/l shall pay the following additional charges:
B.O.D.* $4.95 per 100 pounds of excess over 180 mg/l
C.O.D.* $1.99 per 100 pounds of excess over 450 mg/l
SS $3.31 per 100 pounds of excess over 200 mg/l
Phosphorus $39.98 per 100 pounds of excess over 19 mg/l
*Either B.O.D. or C.O.D. will be used, not both. Option to be selected by the Municipality.
(h) Metering and monitoring fees. In addition to the above charges, each user shall pay a fee for each sampling and metering required for high strength surcharges, industrial cost recovery, or ascertaining pretreatment compliance. A fee shall be charged for each set of samples collected and analyzed. Sampling periods shall not exceed a 24-hour day. If necessary to sample more than one 24-hour day, multiple charges will be made. The fee for such services shall be at actual cost thereof as computed by the Municipal Administrator.
(i) Unscheduled charges. Any system user who is responsible for damage to the system shall be charged the full cost of repair of the damage to the system. The cost shall include, but is not limited to, labor, equipment, materials, administrative expense, interest on borrowed funds, engineering, legal, or other professional fees, and charges to the Municipality by other utilities or departments.
(j) Revenue generated by the user charge shall be deposited in a separate account and used solely for the purpose of covering all operation, maintenance, and replacement costs of the treatment works. Revenues from user charges shall not cover any debt service.
