Application for a permit to construct or reconstruct a sidewalk within the public right of way shall be on the form furnished by the Public Works Director. The form shall set forth the name and address of the applicant, the name and address of the owner of the property adjoining the right of way where the proposed work is to be done, the street address or legal description of the lot or land adjoining the right of way, the number of square feet of proposed sidewalk to be constructed or reconstructed, the material in the existing sidewalk, the material to be used in the proposed construction or reconstruction of the sidewalk, and such other information as may be required. No sidewalk shall be constructed or reconstructed except as described herein until a permit has been obtained from the Public Works Director by the owner of the contiguous property or his or her agent. A contractor must ascertain that a permit has been issued by the Municipality before starting any sidewalk construction or reconstruction. The fee for a sidewalk construction permit shall be as determined from time to time by Council. No permit or fee shall be required for sidewalk construction or reconstruction work performed directly by the Municipality or performed by contractors working for the Municipality.
