913.02  DUTY TO INSTALL SIDEWALKS.
   Every owner of any lot or parcel of land situated within the Municipality shall construct sidewalks along all public streets, avenues, boulevards or lanes abutting such lot or parcel of land upon the earliest of the following:  the construction of any principal structure other than a single- family dwelling requiring a Zoning Permit on such abutting lot or parcel of land; the construction of a single-family dwelling on a parcel of land where such sidewalk construction would be a direct extension of an existing sidewalk; in accordance with any provision of the Waterville Planning and Zoning Code that specifies a schedule of sidewalk construction; or, with respect to previously constructed structures or vacant lots, in accordance with such construction schedule as may be adopted by the Council.  Council may approve exceptions to the foregoing requirements if it is determined for example that a sidewalk would be located in an area where topographical considerations would make the existence of the sidewalk more dangerous than the absence of one (such as a steep slope), that the area has insufficient right-of-way to safely construct the sidewalk or for any other extenuating and unique circumstances that would not be in the best interest of the public health, safety or welfare.  (Ord. 32-13.  Passed 11-12-13.)
