(a) Whoever violates any provision of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00). Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
(b) Regardless of the penalties provided in subsection (a) hereof, an organization convicted for a violation of any provision of this chapter committed by an officer, agent or employee of the organization acting in its behalf and within the scope of his office or employment is guilty of a minor misdemeanor and shall be fined in an amount not to exceed one thousand dollars ($1,000). Each day such violation is committee or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
(c) This section does not prevent the imposition of available civil sanctions against an individual or organization for a violation of any of the provisions of this chapter, either in addition to or in lie of a fine imposed pursuant to this section.
(d) Citations shall be issued to a person, firm or corporation and/or an individual having control over the noise, whether present or not.
