531.03  EXCESSIVE AND UNNECESSARY NOISE PROHIBITED.
   (a)   No person shall make, cause or permit to be made or caused any unnecessary, excessive or offensive noise which injures or otherwise endangers the comfort, repose, health, peace or safety of other persons within the limits of the Municipality.
   (b)   For the purposes of this section, the following shall be presumed to be unnecessary, excessive or offensive noise and in violation of the provisions of subsection (a) above:
      (1)   The harboring or keeping of any animal which is permitted to emit frequent or continuous sounds audible and disturbing to surrounding properties.
      (2)   The operation, playing or permitting the operation or playing of any electronic device or musical instrument which produces, reproduces or amplifies sound so as to be audible and disturbing to surrounding properties, particularly between the hours of  11:00 p.m. to 7:00 a.m.
      (3)   Any outside gathering of persons which is accompanied by loud, vociferous or raucous language, including but not limited to shouting, yelling, whistling, singing or crying, in person or through the use of any device, so as to be audible and disturbing to surrounding properties, particularly between the hours of 11:00 p.m. and 7:00 a.m.
      (4)   The operation of any mechanical or electrical device which creates intermittent or continuous noise and/or vibration which is disturbing to surrounding residential properties.
   (c)   This section shall not apply to noncommercial public speaking or assembly activities conducted in accordance with the provisions of this chapter, nor to public activities conducted with the knowledge and consent of the Municipality.
