§ 37.52 EXCEPTIONS.
   For each publicly owned or occupied building of the town or any of its departments, the department head of the department located in such building shall have the authority to designate one smoking area per building for employees only. The department head shall be responsible for identifying the smoking area filing with the President of the Town Council a report identifying the smoking area. The smoking area must be separated from the non-smoking areas of the building by a wall, door or other partition; that is, it must be a separate from capable of being closed off. The smoking area must be ventilated where feasible and situated so that the air from the smoking area is not drawn into or across the remainder of the building which shall be smoke free. The smoking area must be clearly designated by appropriate signs visible to employees. The smoking area shall have ashtrays and other suitable containers for extinguishing smoking materials. Each department head shall have the authority, notwithstanding the provisions of this chapter, to decline to declare any area a smoking area and to required any employee who wishes to smoke, to do so outside of the building.
