(A) The provisions of this chapter shall be administered by the Code Enforcement Officer or such other town employee or town department as designated by the Town Council.
(B) Violations of this chapter are hereby declared to be a nuisance as defined in Chapter 132 and shall be subject to abatement and the abatement procedure as contained in Chapter 132.
(C) Any person who fails, neglects, or refuses to comply with the provisions of this chapter, after having been given five days notice shall, upon conviction, be fined in the sum not exceeding $50 per day. In enforcing the provisions of this chapter, the town shall also be entitled to collect reasonable attorney’s fees and court costs in addition to any other fines and penalties as provided by this chapter or by law. Each day a violation of this chapter is suffered or permitted to continue, shall constitute a separate violation.
(D) The town’s costs in enforcing this chapter and abating the nuisance declared hereunder shall constitute a lien against the property upon which the nuisance existed, which lien shall be filed, proven and collected by certifying the costs of such abatement to the County Auditor who shall place the total amount certified on the tax duplicate for the property affected, ad the total amount, including any accrued interest shall be collected as delinquent taxes are collected and shall be disbursed to the general fund of the town.
