For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
GARAGE. A garage is a building or other permanent structure, and for purposes of this chapter is given its ordinary meaning. A garage does not include a tarp, plastic sheeting, or any other similar material or impermanent means that are used in an attempt to cover a motor vehicle. It is a defense to a violation of this chapter if a junk car is located in a garage.
JUNK CAR. Any one or all of the below criteria may be used in making a determination that a motor vehicle is a junk car. Any motor vehicle which:
(1) Does not bear a currently valid and legal license plate;
(2) Does not have the appearance of or contain all of the parts and accessories of the same make and model automobile when manufactured and assembled by the manufacturer, which is partially dismantled, non-operating, or wrecked;
(3) Is not in a garage or other building.
