§ 91.03 RULES AND REGULATIONS.
   (A)   No graves shall be mounded above the level of the ground before the grave was opened. It shall be the duty of the sexton to fill in graves so that after ground has fully settled, the land will be flush for convenient seeding so that lots may be cared for efficiently and give best appearance. Do not place sand, stone or gravel on lots as it will have to be removed for seeding.
   (B)   (1)   Waterloo Memorial Cemetery reserves the right to regulate the method of decorating plots, lots, and graves in the cemetery so that a uniform beauty may be maintained. It is not the desire of this board to arbitrarily control or to curb the individual’s interest in the Waterloo Memorial Cemetery. The restrictions are placed only as a means of eliminating obstructions, which make maintenance costs high and it is felt that a well planned, organized beautification is more effective to the overall beauty of the cemetery.
      (2)   No graves shall be mounded above the level of the surrounding ground before the grave was opened. It shall be the duty of the sexton to fill in graves so that after fully settling, the ground will be level for convenient seeding and may be cared for efficiently, thereafter. No sand, stone, or gravel may be placed on any grave, as it will be removed. No flower beds will be permitted on any lot. No digging or planting in the sod is permitted. The cemetery has the right to remove any flowers planted on graves.
      (3)   No lot lines shall be defined by any curbing, fencing, plants or stones of any kind. Any curbing installed before restrictions were established will be removed by cemetery employees, when they have deteriorated and have become unsightly and, or a hindrance to cemetery maintenance. The Waterloo Cemetery will furnish all markers to define lot lines and shall remove all others of any type.
      (4)   Benches shall only be allowed within Waterloo Memorial Cemetery, if they are used as a monument or if a grave space is purchased for installation of the bench. If a grave space is purchased for this purpose, the bench must be placed in line with the headstones of adjoining grave spaces, and said bench must be placed upon a headstone foundation that meets cemetery foundation specifications.
      (5)   Monuments placed in the Waterloo Memorial Cemetery must not be more than a maximum height of seven feet at any point of said monument.
      (6)   Urns will be permitted in the Waterloo Memorial Cemetery but will be restricted to the concrete foundations of each headstone. Broken or damaged urns will be removed by cemetery employees.
      (7)   Shepherds hooks will be permitted in the Waterloo Memorial Cemetery. Only single hooks with a maximum height of five feet will be allowed. Hooks must be placed in the concrete of the headstone foundation and object hanging from hook must be placed over headstone. Trellis’ of any type are not permitted on any grave.
      (8)   No plants, flowers, shrubbery, trees, and creeping or climbing vines shall be planted on any lot or grave. Any existing plant or tree that is now on any lot that hinders the maintenance, or is unsightly will be removed. Planting will only be done by the Waterloo Memorial Cemetery.
      (9)   Live plants and flowers are permitted during the summer months. Potted plants must be placed in a heavy container and set on the concrete foundation. Waterloo Memorial Cemetery assumes no responsibility for the longevity of the life of a plant or flower, or for the container. Live plants will be removed at which time they are no longer cared for or maintained in a timely manner.
      (10)   Funeral floral pieces, flowers and other momentos left after a funeral shall be removed by the Waterloo Memorial Cemetery within seven days of burial.
      (11)   Special memorials such as plotted plants, flower baskets, special wreaths or memorial flags are only permitted for ten days before and ten following holidays: St. Valentines Day, Easter, Mother’s Day, Memorial Day, Father’s Day, Independence Day, Halloween, Veterans’s Day, Thanksgiving and Christmas Day. These special memorials will be removed after the holiday event has passed.
      (12)   Winter wreaths and winter grave decorations are permitted during the winter season, December 1 through March 1. All winter wreaths and grave decorations will be removed before April 1. Any family planning to re-use these decorations must have them removed prior to this date March 1.
      (13)   Any object located in the grass and not within the concrete foundation, extending above ground (regardless of whether part of the object is imbedded into the ground) during the mowing season and not during a holiday event may be removed at anytime by the Waterloo Memorial Cemetery to allow for better maintenance of the cemetery grounds. This includes, but is not limited to cases, cones, crosses, cans, bottles, baskets, globes, jugs, toys of any type, wire flower stems and wire wreath stands, bric-a-brac.
      (14)   All decorations placed in the Waterloo Memorial Cemetery must be securely fastened to or contained within the concrete portion of the headstone foundation, or affixed directly to the monument. Graves without concrete foundations may place their decorations next to the headstone, within what would be considered the foundation limits. Graves with funeral home markers will limit their decorations to one item only. The cemetery is not in any way responsible for loss or damage that might occur to any item or decoration left in the cemetery.
      (15)   Monuments in the cemetery on the east side of Center Street must be placed at the head of the grave. The foundation for these monuments must be 30 inches deep and four inches wider on each side (length and breadth) than the base of the headstone; in other words eight inches wider and eight inches longer than the base of the stone. The foundation should be flush with or no more than one inch above the soil line. All foundation work must be approved by the Waterloo Memorial Cemetery Sexton.
      (16)   Monuments in the cemetery on the west side of North Center Street shall be placed at the end of the grave space adjacent to the path. Lettering on the markers on the east side of the path shall be facing west and markers on the west side of the path shall be facing east on upright monuments. Flat markers shall have the top of lettering on the east side of the path to the east and flat markers on the west side of the path shall be placed with the top of the lettering to the west. This way all of the monuments can be read while on the pathway. Foundations should be placed one inch inside of the lot line. All foundation work must be approved by the Waterloo Memorial Cemetery Sexton. Individual markers shall have a foundation of 42 inches. Double markers shall have a foundation of 84 inches, both with a four-inch border. Foundations for these monuments must be 30 inches deep. The concrete foundation should be flush with or no more than one inch above the soil line in that area. The concrete ingredients shall be six parts washed gravel to one part cement or richer.
      (17)   No monument may be erected on any lot in either the old or new cemetery until the perpetual care fee has been fully paid for and approval has been granted by the Waterloo Memorial Cemetery Sexton.
      (18)   Opening and closing of graves shall be done by employees duly authorized by the Waterloo Memorial Cemetery Board. No change in the location of a grave shall be made after a designation of place of burial has been made by the owner of a lot or his or her duly authorized agent, except on request of owner, and then at the owner’s expense. The Board shall not be held responsible for any mistakes in location caused by anyone except a mistake by an employee of the cemetery.
      (19)   No grave will be opened until the burial permit fee, grave opening and closing fee, lot or titled plot and endowment fee is paid in full. Prices are quoted on the enclosure and are subject to change without notice.
      (20)   The Clerk/Treasurer’s office will send a copy of the Rules and Regulations of the Waterloo Memorial Cemetery with all deeds.
   (C)   No lot lines shall be defined by any curbing, fence hedge, plants or stones. Any curbing installed before restrictions were established will be removed by order of Cemetery Board when in their judgment they have deteriorated and become unsightly and are a hindrance to good cemetery maintenance.
   (D)   No seats, benches nor trellis shall be allowed on any lot.
   (E)   Urns will be permitted in the cemetery.
   (F)   Monuments.
      (1)   In the cemetery on both the east and west sides of road must be placed at the head of the grave. The foundation for same must be 30" deep and four inches wider on each side (length and breadth) than the base of stone; in other words, eight inches wider and eight inches longer than the base of stone. This foundation should be flush with the soil line.
      (2)   In the cemetery on the west side of the road all monuments or markers shall be placed at the end of the grave space, adjacent to path and the lettering on the markers on east side of path shall be placed with the top of the letters to the east and the markers on the west side of path shall be placed with the top of letters to the west. On a monument having a family surname, the surname shall face east. Monuments or markers should be placed one inch inside lot line. Individual markers shall be 12 inches wide by 24 inches long, and if stone, four inches thick. Family markers shall be 12 inches wide by 36, 42, or 48 inches long, and if stone, four inches thick. The foundation for the individual markers shall be 30 inches deep by 42 inches long and the same width as the width of the marker. The foundation for family markers shall be 30 inches deep by 84 inches long by the same width as the marker. Bronze markers are also permitted, but must comply with all the other rules herein. Foundation specifications are the same for bronze markers as for stone markers. Foundation ingredients shall be six parts washed gravel to one part cement or richer.
   (G)   The town states the following fees, costs, and/or sales prices, to-wit:
      (1)   Opening and closing of graves.
         (a)   Opening and closing graves:         
            1.   Opening and closing graves - weekdays (non-holiday): $500 (town-$100; contractor-$400).
            2.   Opening and closing graves - weekends and holidays: $600 (town-$100; contractor-$500).
         (b)   Opening and closing infant burials:
            1.   Up to and including 30 inches in length - weekdays (non-holidays): $200 (town-$75; sexton-$125).
            2.   Up to and including 30 inches in length - weekends and holidays: $300 (town-$75; sexton-$225).
            3.   More than 30 inches is same price as regular grave.
         (c)   Fee for burial of ashes from cremation.
            1.   Fee for burial of ashes from cremation - weekdays (non-holiday): $200 (town-$75; sexton-$125).
            2.   Fee for burial of ashes from cremation - weekends and holidays: $300 (town-$75; sexton-$225).
      (2)   Sale of cemetery lots.
         (a)   The price for all spaces shall be $450 per space.
         (b)   The funds collected from the sale of cemetery lots shall be allocated 100% to the Cemetery Fund.
      (3)   Endowment funds shall be vested as prescribed by law.
      (4)   Pursuant to the State Board of Accounts recommendation, the Town Board acting as the Cemetery Board hereby makes its determination that the principle in the cemetery endowment fund be deemed and considered to be $15,112.63. Any and all funds in the cemetery endowment fund over said $15,112.63 is deemed and considered to be interest as of the date of May 11, 2021.
   (H)   Mausoleum.
      (1)   Sale price of individual crypts shall be $100 which shall be placed in Cemetery Endowment Fund.
      (2)   Since an Endowment Fund has not theretofore been established on mausoleum crypts, none shall be applied at this time nor will annual assessments be applied; but when major repairs to mausoleum are necessary the crypt owners will be notified of such needed repairs and the repairs will be made and crypt owners will be assessed their proportionate share of costs. If such assessment is unpaid six months after date of mailing of assessment any unused crypts will be placed on available list of crypts and when sold that portion necessary to defray assessment will be applicable to the town General Fund and balance deposited in the Endowment Fund.
      (3)   No future sales to anyone in the mausoleum.
