§ 71.01 VEHICLE NOISE REGULATION.
   (A)   No person shall operate or use a motor vehicle of a type subject to state registration on the public streets and highways of this community at any time or under any condition of grade, or load, or acceleration or deceleration or so which is out of repair in such a manner as to create loud and unnecessary grating, grinding, rattling, roaring, screeching, squeaking or other noise which shall unduly disturb the peace and quietude of the community regardless of whether such noise be emitted from the engine or exhaust system or tires on the roadway.
   (B)   No vehicle shall use engine compression brakes or an engine retarder system to stop or slow down said vehicle if said system causes the vehicle’s motor to race in such a manner as to cause the exhaust system to omit a loud, cracking, backfiring or chattering noise unusual to its normal operation, said practice being commonly known as "jake braking."
   (C)   Violation of this section may be punishable by a fine not to exceed $500.
   (D)   Division (B) of this section shall not apply to fire fighting equipment provided such equipment is being operated in the course of responding to a fire or other legitimate emergency.
   (E)   The Town Marshal or his or her designee is directed to post appropriate signs regarding the restrictions contained in division (B) of this section at or near the town limit or other such places as determined by the Town Marshal or his or her designee.
