§ 35.057 DISABILITY RETIREMENT PENSION FOR REGULAR PARTICIPANTS.
   (A)   Any regular participant who incurs a non-work-related disability or a work-related disability, as determined pursuant to § 35.126, shall be entitled to a disability pension equal to the greater of:
      (1)   Twenty-five percent of the participant’s final average base pay; or
      (2)   The participant’s accrued benefit on the date of the participant’s separation from service with the city, provided the application for disability is filed with the Pension and Benefits Office prior to termination of service.
   (B)   Any regular participant who incurs a work-related disability, as determined pursuant to § 35.126 which renders such participant unable to perform any gainful economic activity which may exist in the national economy shall be entitled to a disability pension equal to the greater of:
      (1)   Fifty percent of the participant’s final average base pay; or
      (2)   The participant’s accrued benefit on the date of the participant’s separation from service with the city, provided the application for disability is filed with the Pension and Benefits Office prior to termination of service.
   (C)   The disability pension benefit shall be payable on the first day of the month following the participant’s termination with the city as a result of the disability.
