§ 35.036 PARTICIPATION.
   All participants who are participating in the retirement system as of June 30, 2003 shall continue as participants subject to the provisions of the retirement system. Any person who shall be employed by the city on or after July 1, 2003 on a full-time basis, and who is not participating in another retirement plan maintained by the city intended by the city to constitute a retirement system, as defined in 26 U.S.C. § 3121(b)(7)(F) for purposes of satisfying the city’s FICA obligation for the members, shall, as a condition of employment, on the first day of full-time employment with the city, provided the employee is in pay status, be required to participate in the retirement system in accordance with its terms, and the participation shall be a condition of continued employment with the city. However, any person who has passed his fiftieth birthday when entering the service of the city shall not be required to participate, but the person may elect on a one-time irrevocable basis within the first 30 days of service to participate in the retirement system and failing to so elect, such person shall not thereafter be eligible to participate. FICA is payable up through the day the employee makes an election to participate in the Retirement System. Participation shall be effective retroactive to the employee’s date of hire. Once the election is made, the employee will pay required pension contributions retroactive to his or her participation date.
