A person who operates or causes to be operated a sexually oriented business which is not in compliance with this chapter is subject to a suit for injunction as well as prosecution for the criminal violation. Such violation shall be punishable as a class C misdemeanor according to section 1-4-1 of this code, and if an injunction must be sought, attorney fees and costs will be assessed at the discretion of the court against the sexually oriented business.
