For purposes of this title, the following words and phrases shall have the meanings herein prescribed:
APPEALS OFFICER: | The City Manager, as designated by the City Council, is responsible for receiving the information from the City and appellant regarding the denial or suspension of a certificate and issuing a decision as required by this article. |
BUSINESS: | Includes all kinds of vocations, occupations, professions, enterprises, establishments and all other kinds of activities and matters, together with all devices, machines, vehicles and appurtenances used therein, any of which are conducted for private profit, or benefit, either directly or indirectly, on any premises in the City. |
CITY: | The City of Washington. |
EMPLOYEE: | The operator, owner, or manager of a place of business; any person or persons employed by an operator, owner, or manager in the operation of a place of business in any capacity, whether part time or full time; and any sales persons, agents, or independent contractors engaged in the furtherance of a business activity in any capacity, regardless of the method of compensation. As used herein, the term “employee” is intended to include everyone engaged in the operation of the business, including all owners if there be more than one. |
ENGAGING IN BUSINESS: | Includes, but is not limited to, the sale of tangible personal property at retail or wholesale, the manufacturing of goods or property and the rendering of personal services for others for a consideration by persons engaged in any profession, trade, craft, business, occupation or other calling, except the rendering of personal services by an employee to his employer under any contract of personal employment. |
HOME OCCUPATION: | The conducting of any business, transaction or activity for which consideration of any nature is received that is conducted in accordance with chapter 4 of this title. |
LICENSE: | The certificate or document issued by the City evidencing permission or authority from the City to the holder named therein to carry on a particular business or to pursue a particular operation or occupation. To be valid, a license must be signed by the License Officer and the Mayor. |
LICENSE OFFICER: | The City Recorder and/or Deputy Recorder are designated and appointed as the License Officers. |
LICENSEE: | The person to whom a license has been issued pursuant to the provisions of this title, and shall include individual persons, partnerships, joint ventures, associations, clubs, trusts, corporations or any other entity qualified by law to carry on any of the business activities referred to herein. The term “person,” as used herein, is either an applicant or “licensee,” as herein defined. |
OFFSITE IMPACT: | The effects on the neighborhood and community which are created as a result of the business, where the combined effects of the home-based business and the primary residential use, materially exceeds the offsite impact of the primary residential use alone. |
PLACE OF BUSINESS: | Each separate location maintained or operated by the licensee within the City from which a business activity is conducted or transacted. |
WHOLESALE: | A sale of tangible personal property by wholesalers to retail merchants, jobbers, dealers or other wholesalers for resale, and does not include a sale by wholesalers or retailers to users or consumers not for resale, except as otherwise specified. |
WHOLESALER: | A person doing a regularly organized wholesale business and selling to retail merchants, dealers or other wholesalers, for the purpose of resale. (Ord. 2022-64, 12-14-2022) |
