Violation of this chapter is an infraction, subject to penalty as provided in section 1-4-1 of this code. Each overnight use constitutes a separate offense. Enforcement shall be by the local law enforcement officer or other official charged with and responsible for the duties of enforcing local laws. Additionally, any parcel in any commercial zone which has previously been granted a conditional use permit which set specific conditions on the owner to not permit overnight camping shall not be excused (by the requirements of this chapter) from their obligation to routinely and adequately monitor their property and to specifically advise users of their property that overnight camping is in violation of a city ordinance and is also not permitted under the property owner's conditional use permit.
