5-2-3: PARKING REGULATIONS:
   A.   Parking Parallel To Curb: No person shall park a vehicle headed in the direction of lawful traffic movement and with the right hand wheels of the vehicle within eighteen inches (18") of the curb or edge of the roadway, except as otherwise provided in this section.    B.   Lights On Parked Vehicles: Whenever a vehicle is lawfully parked upon any street within a business or residence district, no lights need be displayed upon the parked vehicle. (1989 Code § 11-340-2)
   C.   Unattended Vehicle; Duty Of Driver:
      1.   No driver of a motor vehicle shall permit such vehicle to stand unattended without first stopping the engine, locking the ignition and removing the key, or when the motor vehicle is standing upon any perceptible grade, without effectively setting the brakes thereon and turning the front wheels to the curb or side of the street.
      2.   It shall be unlawful for any person to park a truck of the capacity in excess of one ton rated capacity on any street where there is a perceptible grade, unless the wheels of the truck are securely blocked, and the front wheels, if facing down grade, turned toward the curb, and if facing up grade, the back of the front wheels turned toward the curb.
      3.   It shall be unlawful for any person to park a truck on any parking lot or area abutting any street within the city where there is a perceptible grade without securely blocking the wheels of the truck. (1989 Code § 11-340-3)
   D.   Illegally Parked Vehicles; Removal: Whenever any officer finds a vehicle parked or standing upon a street in violation of any provisions of this section, the officer is hereby authorized to move the vehicle, or require the driver or other person in charge of the vehicle to move the same to a position off the main traveled part of the street.    E.   Stopping Or Parking Prohibited In Specified Places: No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a police officer or traffic control device, in any of the following places:
      1.   On a sidewalk.
      2.   In front or within two feet (2') of a private driveway.
      3.   Within an intersection.
      4.   Within five feet (5') of a fire hydrant.
      5.   Within twenty feet (20') of a crosswalk at an intersection.
      6.   Within thirty feet (30') upon the approach to any flashing beacon or traffic control device located at the side of a roadway.
      7.   Between a safety zone and the adjacent curb or within thirty feet (30') of points on the curb immediately opposite the ends of a safety zone, unless authorized signs or markings indicate a different length.
      8.   Within fifty feet (50') of the nearest rail or railroad crossing.
      9.   Within twenty feet (20') of the driveway entrance to any fire station and on the side of a street opposite the entrance when properly signposted.
      10.   Alongside or opposite any street excavation or obstruction when stopping, standing or parking would obstruct or be hazardous to traffic.
      11.   Upon any bridge or culvert structure upon a street or within a street tunnel or underpass.
      12.   At any place where official signs or traffic markings prohibit stopping, standing or parking.
      13.   With the left hand side of the vehicle to the curb, except as otherwise permitted on one-way streets. (1989 Code § 11-340-5; amd. 2007 Code)
   F.   Double Parking: No person shall park, stand or stop a vehicle upon the roadway side of another vehicle which is parked, standing or stopped, except while actually engaged in loading or unloading passengers, or in compliance with directions of a police officer or traffic control device, or when necessary to avoid other traffic. (1989 Code § 11-340-6)
   G.   Approach To Parking Space:
      1.   No person shall move his vehicle in any manner or leave a parking space and then reenter it to avoid the intent of this section.
      2.   Every driver about to enter a parking space being vacated shall stop his vehicle and wait to the rear of the vehicle in the actual process of vacating the parking space, and having so waited, shall have prior right to the parking space over all other drivers.
      3.   No driver shall stop his vehicle ahead of a parking space being vacated and attempt to interfere with a driver who has waited properly to the rear of a parking space being vacated.
      4.   No driver shall stop and wait for a parking space unless the vehicle vacating the space is actually in motion in the process of vacating.
      5.   No person shall park any vehicle in such a manner or under such conditions as to obstruct any sidewalk, crossing or private driveway. (1989 Code § 11-340-7)
   H.   Parking In Alleys: No person shall park a vehicle within an alley, except during the necessary and expeditious loading and unloading of merchandise, and no person shall stop, stand or park a vehicle within an alley in such position as to block the driveway entrance to any abutting property or interfere with the free movement of traffic through the alley. (1989 Code § 11-340-8)
   I.   Time Limited Parking: No person who owns or has possession or control of any vehicle shall park the vehicle upon any street or alley for more than a consecutive period of forty eight (48) hours. (1989 Code § 11-340-9)
   J.   Parking Contiguous To Schools: No person shall park a vehicle upon that side of any street contiguous to any school property during school hours when posted with adequate signs prohibiting the same. (1989 Code § 11-340-10)
   K.   Parking On Narrow Streets Or Alleys: No person shall park a vehicle:
      1.   On any private or public street or alley where the width of the roadway is less than twenty feet (20').
      2.   On the south or east side of any private or public street or alley where the width of the roadway is over twenty feet (20'), but less than thirty feet (30'), unless otherwise directed by traffic control devices.
      3.   Upon any private driveway within a central traffic district where the width of the driveway is less than twenty feet (20'). (1989 Code § 11-340-11)
   L.   Parking For Certain Purposes Prohibited:
      1.   Parking Prohibited For Certain Purposes: No person shall park, stand, stop or allow to be parked or operated a motor vehicle upon any roadway or its public right of way or area abutting any roadway within the city, any public parking lot, or any private parking lot accessed by the public for parking, for the principal purpose of:
         a.   Displaying such vehicle for sale, except in a licensed auto sales lot;
         b.   Greasing, repairing or servicing such vehicle, except repairs necessitated by an emergency;
         c.   Displaying or advertising of any matter;
         d.   Selling foodstuffs or any other merchandise;
         e.   Parking, abandoning or storing unlicensed or improperly registered vehicles.
      2.   Time Limited Parking: No person who owns or has possession or control of any vehicle shall park the vehicle upon any street or alley for more than a consecutive period of forty eight (48) hours.
      3.   Vehicles Moved Then Reparked On Same Block Face: Any vehicle which is moved from a parking spot and then reparked on the same street block face within twenty four (24) hours from the time of said removal shall be deemed to have been continuously parked for the purposes of this section. "Block face" means the side of the street where the vehicle was parked between two (2) intersecting streets.
      4.   Vehicle Defined: "Vehicle" includes a motor vehicle, trailer, semitrailer, off highway vehicle, camper, park model recreational vehicle, manufactured home, and mobile home. (Ord. 2015-26, 9-9-2015)
   M.   Standing And Parking On One-Way Roadways: In the event a street includes two (2) separate roadways and traffic is restricted to one direction upon each of said roadways, no person shall stand or park a vehicle upon the left side of either of such roadways. (1989 Code § 11-340-13)
   N.   No Parking Zones:
      1.   The public works director is hereby authorized, subject to provisions and limitations of this title and after a comprehensive study and with the approval of the city council, to have placed, and when required herein shall cause to be placed and maintained appropriate signs or traffic markings to indicate standing or parking regulations, and the traffic markings shall designate the zones and shall have the meanings herein set forth:
         a.   "Red" shall mean no stopping, standing or parking at any time, except for the individual purposes of emergency vehicles.
         b.   "Yellow" with the words "restricted zone" stenciled thereon, shall mean no stopping, standing or parking, except as stated on the signs or markings giving notice thereof, except that this provision shall not apply on Sundays and legal holidays. (Ord. 98-26, 9-23-1998)
      2.   When appropriate signs or traffic curb markings have been erected or placed according to this subsection, no person shall stop, stand or park a vehicle in any zone in violation of any of the provisions of this section.
      3.   For persons parking semitrucks (which term is defined in subsection Q of this section, and other trucks exceeding 21/2 tons), or vehicles, who park in violation of subsections N1 and N2 of this section, the penalty shall be a fine of twenty five dollars ($25.00).
      4.   The fine for unauthorized parking in a handicapped parking space is one hundred twenty five dollars ($125.00). (1989 Code § 11-340-14; amd. 2007 Code)
   O.   Applicability; Exceptions: The provisions of this section prohibiting the standing or parking of a vehicle shall apply at all times or at those times herein specified, or as indicated on official signs, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.    P.   Parking Limited By Signs:
      1.   When proper signs or traffic markings are erected or placed by proper authority of the city council in each block giving notice thereof, it shall be unlawful for any person to park a vehicle or permit the vehicle to remain parked for a longer time than the time specified between the hours shown by the sign and markings, except Sundays and legal holidays.
      2.   Whether by this section or by resolution of the city council, a parking time limit is imposed or parking prohibited on designated streets or areas or parts of streets, the public works director shall cause to be erected, placed and maintained appropriate signs in at least three (3) places in each block giving the traffic marking and giving notice thereof of the parking regulations. Unless such markings giving notice thereof are in proper place, this parking regulation shall be ineffective. (1989 Code § 11-340-16; amd. 2007 Code)
   Q.   Truck Parking:
      1.   Definitions:
    GROSS WEIGHT: The weight of a vehicle without load, plus the weight of any load thereon.
   MOTOR VEHICLE: Every vehicle which is self-propelled.
   PARK: The standing of a vehicle whether occupied or not.
   SEMITRUCK: Any vehicle-trailer combination that has at least three (3) axles and is of the type that is commonly used for the commercial transport of merchandise, goods, building materials or other items on the public thoroughfares.
   STREET: The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular traffic.
   TRAILER: Every vehicle with or without motive power designed for the commercial transport of merchandise, goods, building materials or other items on the public highways and for being drawn by a motor vehicle.
      2.   Parking Prohibitions:
         a.   It shall be unlawful for any person to park a semitruck or a trailer on any street of the city, except as permitted below.
         b.   Nothing stated in this section shall prohibit the parking of the following vehicles on city streets:
            (1)   Semitrucks or trailers in the process of commercial delivery or receipt of merchandise, goods, building materials or other items within the city, as long as the semitrucks or trailers do not remain parked for a continuous period of more than two (2) hours.
            (2)   Semitrucks or trailers that have become inoperable due to breakdowns or tire damage, as long as the semitrucks or trailers do not remain parked for a continuous period of more than eight (8) hours.
         c.   The chief of police, after making reasonable effort to locate the owner, is empowered to effect removal and impoundment of a semitruck or trailer that is in violation of this subsection, and the cost of removal and impoundment shall be charged to the owner or person claiming the impounded vehicle or trailer. In addition, a violation of this subsection shall be a class B misdemeanor or lesser offense as determined by the city prosecutor.
      3.   Weight Prohibitions:
         a.   Except as permitted below, it shall be unlawful for any person to operate upon any street of the city any motor vehicle, including a semitruck or other motor vehicle-trailer combination, that has a gross weight in excess of twenty thousand (20,000) pounds per axle or thirty four thousand (34,000) pounds per set of tandem axles.
         b.   Nothing stated in this subsection shall prohibit the operation on city streets of motor vehicles and motor vehicle- trailer combinations, including semitrucks, that are in the process of delivering merchandise, goods, building materials or other items to locations within the city and that do not have a gross weight in excess of twenty thousand (20,000) pounds per axle or thirty four thousand (34,000) pounds per set of tandem axles.
         c.   Nothing stated in this subsection shall prohibit the operation on city streets of motor vehicles and motor vehicle- trailer combinations, including semitrucks, that have a valid overweight permit issued by the state highway patrol and that do not have a gross weight in excess of twenty thousand (20,000) pounds per axle or thirty four thousand (34,000) pounds per set of tandem axles.    R.   Penalty: Any person who violates the provisions of this section shall be guilty of an infraction, subject to penalty as provided in section 1-4-1 of this code, except:
      1.   Any person who parks a semitruck or trailer in violation of this section shall be guilty of a class B misdemeanor, subject to penalty as provided in section 1-4-1 of this code.
      2.   Any person who operates a motor vehicle or motor vehicle- trailer combination, including a semitruck, on any city street with a gross weight that exceeds that permitted by this section shall be guilty of a class B misdemeanor, subject to penalty as provided in section 1-4-1 of this code.
