(A) All livestock, such as horses, cattle, swine, sheep, goats, and poultry which are kept in the city as of May 1, 2022, shall be registered with the city Animal Control Office on or before July 1, 2022. There is no fee to register such animals.
(B) Subsequent to July 1, 2022, no person residing in a residentially-zoned area of Washington shall acquire, keep, harbor or maintain livestock except those properly registered as of July 1, 2022.
(C) Properly registered livestock in residentially-zoned areas of Washington may not be replaced after they have been sold, traded or given away or after the death of the animal. A waiver of this provision may be available under § 91.02B.
(D) Persons residing in the City of Washington who fail to properly register their livestock as required by July 1, 2022, will be subject to a citation and a daily fine of $10.
(E) Residents of areas of the city which are zoned agricultural may acquire, keep, harbor and/or maintain such livestock but only by complying with the following conditions:
(1) All such animals must be kept in a fenced area, no part of which is closer than 150 feet from the owners' property line, which adjoins a residentially zoned property, and 150 feet from any adjoining residential dwelling, provided that the subject residential zoning or dwelling exists on May 1, 2022.
(2) The fenced area shall provide no less than 2 acres per each horse and no less than 1 acre per head of cattle. Similarly, no less than 1 acre per 2 goats or swine. Chickens and other poultry should be restricted to no more than 10 per acre.
(F) Persons failing to comply with any other provision of this section are subject to citation and daily fines of $100 per day.
(G) Emotional support animals, therapy or comfort animals and companion animals are not SERVICE ANIMALS as that term is defined by the Americans with Disabilities Act. Pursuant to said Act, a SERVICE ANIMAL is defined as a dog of any breed that has been individually trained to do work or perform tasks for an individual with a disability. The task performed by the dog must be directly related to the person's disability.
(H) The Washington Saddle Club Inc., in Washington at 1215 Cosby Road at S.W. 10th St, and the Daviess County 4-H Club Association in Washington at 4-H Way are exempt from the provisions of this section.
(I) Owners of property located in areas of the city which are zoned Commercial or Industrial may temporarily harbor and/or maintain such livestock, when harboring and/or maintenance of livestock is considered part of a use allowed under the city's zoning code, such as a meat processing plant or veterinarian clinic.
