§ 112.01 GENERAL PROVISIONS.
   (A)   The regulation of temporary and non-permanent peddlers who engage in door-to-door solicitation is to protect against criminal activity, including fraud, to minimize the unwelcome disturbance of citizens and the disruption of privacy as necessary in the interest and promotion of the public health, safety, convenience, peace, comfort, order and public welfare of the city and the citizens and inhabitants thereof.
   (B)   Whereas the regulation of temporary and non-permanent peddlers applies to all persons or entities who seek to call upon the city’s citizens at their homes for the purposes of selling foods and/or services and is, therefore, content neutral;
   (C)   Whereas the regulation serves the legitimate government objective of preventing crime by requiring criminal background check of temporary and non-permanent peddlers and prohibiting sales calls after sunset and before sunrise;
   (D)   The regulation serves the legitimate government objective of protecting the privacy of citizens, including the quiet enjoyment of their homes, by prohibiting sales calls at homes at which the owner or occupant displays a "No Soliciting" or sign of similar meaning;
   (E)   The regulation allows temporary or non-permanent peddlers to make sales calls during daylight hours at homes which do not display "No Soliciting" or signs of similar meaning so long as peddlers have registered and compiled with the application process and rules for temporary and non-permanent peddlers; and the regulation is narrowly tailored to serve these legitimate governmental interests of crime prevent and protecting the privacy of citizens, and these interests could not be accomplished with less restrictive regulation.
   (F)   Definitions. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      GOODS. Personal property of any kind and shall include goods provided incidental to services offered or sold.
      TEMPORARY AND NON-PERMANENT PEDDLERS. Any individual who, for himself or herself, or for a partnership, association or corporation, offers services, sells goods or takes sales orders for the later performance of services or the delivery of goods, at any location other than the permanent business place or residence of the individual, partnership, association or corporation, and shall include, but not limited to, peddlers, solicitors and transient merchants. The sale of goods includes donations required by the peddler for the retention of goods by a donor or prospective donor.
