§ 73.10 MUFFLER REQUIRED FOR MOTORIZED BICYCLES; TAMPERING WITH MUFFLERS AND MANUFACTURER’S EQUIPMENT PROHIBITED.
   It shall be unlawful for any person to tamper with any manufacturer's equipment on any motorized bicycle if the effect of the tampering would render the motorized bicycle less safe, and every motorized bicycle shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive and unusual noise or annoying smoke, and no person shall use a muffler cut-out, bypass or similar device upon a motorized bicycle operated on any city street, alley, roadway or highway.

§ 73.11 OPERATORS OF ALL VEHICLES WITHIN THE CORPORATE LIMITS SHALL OBSERVE AND OBEY ANY AND ALL TRAFFIC LAWS AND REGULATIONS.
   The operators of all vehicles within the corporate limits of the city of Washington shall observe and obey any and all traffic laws and regulations currently in force in the State of Indiana and the city so adopts same and incorporates same into the Washington Code of Ordinances and authorizes the Washington Police Department to enforce the laws and regulations adopted by this section and to issue citations to those individuals believed to have violated any law or regulation as adopted by this section, which violation occurs within the corporate limits of the City of Washington.

§ 73.99 PENALTY.
   (A)   Violations of any of the provisions herein, or violations of any of the applicable provisions of the traffic code and any other ordinances of the city as applied to operators and owners of bicycles and motorized bicycles, shall constitute an infraction, and the person violating the provisions shall be subject to fines, and possible impoundment, as set out below.
   (B)   Any person violating the provisions of this chapter shall be deemed guilty of an infraction, and upon being found liable therefore, shall be punishable by a fine of not more than $100, nor less than $10.
   (C)   The minimum fine of $10 set out hereinabove cannot be waived or suspended.
   (D)   In the event an owner or operator of any bicycle or motorized bicycle is found to have committed 3 or more violations of the provisions of this chapter within any 24-hour period, he or she shall be deemed a habitual offender of the traffic code, and shall be charged with an infraction, and upon any person pleading guilty or being found guilty of the infraction, the Police Department may, in its sound discretion, seize and impound any bicycle or motorized bicycle for a period of no more than 1 year. The bicycle or motorized bicycle, if belonging to a person under 16 years of age, shall be surrendered by the Police Department to the child's parent or guardian, or to the child, if he or she is accompanied by his or her parent or guardian.
