§ 52.119 CHARGES TO BE BASED ON STRENGTH AND CONTENT OF DISCHARGES.
   (A)   In order that the rates and charges may reflect the costs of providing service rendered to users, the city shall base its charges not only on the volume, but also on strength and character of the stronger-than-normal domestic sewage, and shall require the user to determine the strength and content of all sewage and wastes discharged, either directly or indirectly into the sewage system, in the manner and by the method as the city may deem practicable in the light of the conditions and standing circumstances of the case, in order to determine the proper charge. The user shall furnish a sampling point, available to the city at all times.
   (B)   Normal sewage domestic waste strength should not exceed a biochemical oxygen demand (BOD) of 300 milligrams per liter of fluid; suspended solids in excess of 300 milligrams per liter of fluid; or Total Kjeldahl Nitrogen (TKN) in excess of 35 milligrams per liter of fluid. Additional charges for treating stronger-than-normal domestic waste shall be made on the following basis:

   (C)   The determination of suspended solids and 5 day biochemical oxygen demand contained in the waste shall be in accordance with the current addition of Standard Methods for the Examination of Water, Sewage and Industrial Wastes, as written by the American Public Health Association, the American Waterworks Association and the Water Pollution Control Federation.
   (D)   TKN as referenced in division (B) above is an abbreviation for Total Kjeldahl Nitrogen and is defined as a measure of organic nitrogen present in wastewater.
   (E)   The rates set forth shall become effective on the following dates:
      (1)   Phase I: Includes 19.30% of increase in rates, exclusive of base rate change and surcharges, effective April 1, 2002.
      (2)   Phase II: Includes additional 9.65% of increase in rates, exclusive of base rate change and surcharges, effective January 1, 2003.
      (3)   Phase III: Includes additional 9.65% of increase in rates, exclusive of base rate change and surcharges, effective January 1, 2004.
