§ 35.03 CITY PROVIDING PART OF COST OF HEALTH INSURANCE FOR RETIRED EMPLOYEES.
   (A)   The City of Washington will pay 50% of cost of insurance per employee per month toward the premium cost for health insurance for retired employees of the City of Washington. This section shall be for the benefit of employees who retire on and after the effective date of this section. In addition, the section shall also be for the benefit of employees who retired prior to the effective date of this section and who are, as of the date of passage of this section, currently participating in the group health insurance program. However, nothing in the passage of this section shall be construed to mean that employees who retired prior to the passage of this section shall be entitled to request or receive back pay or back awards at the rate of $150 per month. They shall be entitled to only $100 per month until the effective date set forth below.
   (B)   The effective date of this amendment shall be made retroactive back to January 1, 2004.
   (C)   This section shall be read and interpreted in conjunction with I.C. 5-10-8-2.2 pertaining to public safety employee, and I.C. 5-10-8-2.6 pertaining to public employees generally.
   (D)   Pursuant to the referenced state statutes, retired employees must request insurance coverage in writing within 90 days of the employee’s retirement date.
   (E)   The city’s obligation for payment as set forth in this section shall continue until such time as the retired employee is eligible for Medicare, at which time the payments by the city pursuant to division (A) above shall cease.
