§ 33.02 CONTINUING EDUCATION FUND FOR POLICE DEPARTMENT CREATED.
   The General Assembly has established by state statute a certain fund to be established by cities and towns for the continuing education fund of the city and town law enforcement agencies, which state statute by reference is incorporated and made a part hereof:
   (A)   The fund shall be funded by an additional $3 charge, which will be added to the court costs collected from each person receiving and admitting to a traffic complaint/infraction, shall be collected by the Clerk of the County Court, and shall be tendered to the Clerk-Treasurer of the city on a regular and periodic basis in addition to other monies presently being transferred from the County Court for other costs received by the Department as a result of court costs and fines received by the issuance of city traffic tickets on infractional complaints involving moving and non-moving traffic violations.
   (B)   The state statute requires that the city establish a separate fund and keep these monies separate from the general fund of the city, and the funds are to be used specifically for the purpose of defraying law enforcement educational requirements of the Police Department of the city.
   (C)   There should be and is established a Continuing Education Fund for the Washington Police Department, and the Clerk-Treasurer is ordered and directed to establish the fund and, upon receipt of monies from the Clerk of the County Court, to place the monies in the account and keep same separate from other monies for the purpose of using the funds as deemed necessary, appropriate and approved for the educational requirements of the City Police Department pursuant to their law enforcement education.
