§ 30.67 BOARD OF PUBLIC WORKS AND SAFETY TO OPERATE CITY TRANSPORTATION SYSTEM.
   (A)   Pursuant to I.C. 36-9-2-2, the city does hereby ratify, by ordinance, a resolution passed by the city in 1973 establishing the Washington Transportation System, and does by this section establish the same in accordance with the powers extended to the city in I.C. 36-9-2-2.
   (B)   The transportation system shall continue to be under the authority of the Board of Public Works and Safety as was previously established by resolution and practice since April 9, 1973, and the Council does specifically reject the establishing of an urban mass transportation system under I.C. 36-9-4-1, et seq. for the reason that the Council does not wish the bus system of the city to be under a separate Board of Directors with a separate taxing unit authority, and by this section expresses the desire to continue the operation, the management, the accounting for and controlling of funds within the Washington Transportation System in the same manner as the same operation, management and control of funds has been handled for the past 11 years.
   (C)   The Board of Public Works and Safety is specifically authorized by this section to manage and operate the transportation system, and the Clerk-Treasurer is authorized and directed to maintain a separate accounting of any and all funds relating to the Washington Transportation System and shall not commingle funds with any other departmental or general fund monies.
   (D)   The Board of Works is authorized to operate and manage the transportation system in a commercially reasonable manner, and shall be obligated to set forth for approval of the Council any expenditures.
