§ 30.40 COUNCILMANIC DISTRICTS.
   (A)   The Common Council of the City of Washington, Indiana, desires to amend the Code Of Ordinances as it describes the 5 Council Districts in the city as required by I.C. 36-4-6-4 which provides that the city must establish the districts in 2002, every 10 years after that, and when required to assign annexed territory to a district.
      (1)   Council District 1 shall be comprised of Precincts Nos. 5 and 15, having an approximate population based on the 2020 census of 2,407.
      (2)   Council District 2 shall be comprised of a portion of Precinct No. 6, Precinct No. 7 and a portion of Precinct No. 12, having an approximate population based on the 2020 census of 2,368.
      (3)   Council District 3 shall be comprised of Precincts Nos. 8, 9 and a portion of Precinct No. 10 having an approximate population based on the 2020 census of 2,408.
      (4)   Council District 4 shall be comprised of a portion of Precinct No. 10, Precinct No. 11 and a portion of Precinct No. 12 having an approximate population based on the 2020 census of 2,395.
      (5)   Council District 5 shall be comprised of a portion of Precinct No. 6 and Precincts Nos. 13 and 14, having an approximate population based on the 2020 census of 2,439.
      (6)   The purpose of this section is to ensure, pursuant to I.C. 36-4-6-4(b), that the districts, among other requirements, contain as nearly as is possible, equal population.
      (7)   Council District 2 represents a change in that formerly District 2 was comprised of Precinct Nos. 6, 7 and 12.
      (8)   Council District 3 represents a change in that formerly District 3 was comprised of Precinct Nos. 8 and 9 only.
      (9)   Council District 4 represents a change in that formerly District 4 was comprised of Precinct Nos. 10 and 11 only.
      (10)   Council District 5 represents a change in that formerly District 5 was comprised of Precinct Nos. 13 and 14 only.
   (B)   Pursuant to the provisions of I.C. 36-4-6-4, the city is hereby divided into five (5) separate Councilmanic, numbered, described and bounded districts, to-wit:
      (1)   District 1.
Beginning at the intersection of the north corporate boundary line of the City of Washington, on the east side of State Highway 57, with the center line of State Highway 57 and running thence southwesterly on the center line of the highway to the center line of Bedford Road; then east on the center line of the road to the center line of N.W. Fourteenth Street; then north and east on the center line of Bedford Road to the center line of N.E. Seventeenth Street; then northeasterly and east on the center line of Bedford Road to the center line of N.E. Twenty-First Street; then south on the center line of N.E. and S.E. Twenty-First Street to the center line of U.S. Highway 50; then west on the center line of the highway to the center line of State Highway 257; then southeasterly on the center line of State Highway 257 to the south corporate boundary line; then east on the corporate boundary line to the east right-of-way line of State Highway 257; then on the corporate boundary line the following 5 courses: (1) southeasterly on the east right-of-way line of State Highway 257 to the southwest corner of Woodland Subdivision, Phases I, II and III, (2) east on the south line of the subdivision to the southeast corner of the subdivision, (3) north on the east line of the subdivision to the south line of Cherry Tree Plaza, (4) east on the south line of Cherry Tree Plaza, approximately 275 feet, to the southeast corner of the Cherry Tree Plaza, (5) north on the east line of Cherry Tree Plaza to a corner of the corporate boundary line; thence east approximately 1,183 feet to a point directly west of a point located 20 feet west and 1,183 feet north of the southeast corner of Location 134, Township 3 North, Range 7 West, said point being located on the west right-of-way line of County Road 100 East; thence east to the east line of the southwest quarter of the northwest quarter of Section 36, Township 3 North, Range 7 West; thence south, along the east line of the southwest quarter of the northwest quarter of Section 36, to the southeast corner of the southwest quarter of the northwest quarter of Section 36; thence east, along the south line of northwest quarter of Section 36, to the southeast corner of the northwest quarter of Section 36; thence east, along the south line of the northeast quarter of Section 36, to the west line of Section 31, Township 3 North, Range 6 West; thence east, along the south line of the north half of Section 31, to the east right-of-way line of Interstate Highway 1-69; thence northerly, along the east right-of-way line of Interstate Highway 1-69, to the south line of a 30.33 acre tract of land deeded to GFI Investment, LLC by Corporate Deed dated July 29, 2005 and recorded in Instrument No. 10-0810 in the Daviess County Recorder's office; thence northeasterly and southeasterly, along the south line of said 30.33 acre tract of land, to the southeast corner of said 30.33 acre tract of land and the southwest corner of a 8.71 acre tract of land deeded to GFI Investment, LLC by Corporate Deed dated July 29, 2005 and recorded in Instrument No. 10-0810; thence northeasterly, along the south line of said 8.71 acre tract of land, to the southeast corner of said 8.71 acre tract of land and the east line of Section 31; thence north, along the east line of Section 31, to the northwest corner of Section 32, Township 3 North, Range 6 West; thence east, along the north line of Section 32, to the east right-of-way line of County Road 300 East extended south to the north line of Section 32; thence north, along the east right-of-way line of County Road 300 East, to a point on the extended south boundary line of a tract of land identified as Parcel Number 14-09-30-100-003.000-016, in the Daviess County Auditor's office; thence west, along the south boundary line of said parcel, to the southeast corner of said parcel; thence west, along the south boundary line of said parcel, to the southeast corner of a tract of land identified as Parcel No. 14-09-30-500-001.000-016; thence west, along the south boundary line of said parcel, to the southeast corner of a tract of land identified Parcel No. 14-09-30-200-002.000-016; thence west, along the south boundary line of said parcel, to the east right of-way line of Interstate Highway 1-69; thence west to the west right-of-way line of Interstate Highway 1-69; thence west, along the south boundary line of Parcel No. 14-09-30-200-002.000-016, to the southeast corner of a tract of land identified as Parcel No. 14-09-30-500-001.000-016; thence west, along the south boundary line of said parcel, to the southeast corner of a tract of land identified as Parcel No. 14-09-30-500-001.001-016; thence west, along the south boundary line of said parcel, to the southeast corner of a tract of land identified as Parcel No. 14-10-25-100-013.000-016; thence west, along the south boundary line of said parcel, to the southeast corner of a tract of land identified as Parcel No. 14-10-25-800-017.000-016; thence west, along the south boundary line of said parcel, to the southeast corner of a tract of land identified as Parcel No. 14-10-25-100-016.000-016; thence west, along the south boundary line of said parcel, to the southwest corner of said parcel, and the east boundary line of Summerhill Addition; thence north, along the east boundary line of Summerhill Addition, to the northeast corner of said addition; thence west, along the north boundary line of Summerhill Addition, to the northwest corner of said addition and the east boundary line of a tract of land presently or previously owned by Charles M. Beginning at the intersection of the north corporate boundary line of the City of Washington, on the west side of State Highway 57, with the center line of State Highway 57, and running thence southwesterly, along the center line of State Highway 57, to the center line of Bedford Road; thence east, along the center line of Bedford Road, to the center line of Northeast Ninth Street; thence south, along the center line of Northeast Ninth Street, to the center line of East Van Trees Street; thence west, along the centerline of East Van Trees Street, to the centerline of State Highway 57; thence south, along the center line of State Highway 57, to the center line of the CSX Transportation Railroad; thence south and southwesterly, along the center line of State Highway 57, to the center line of Highland Avenue; thence west, along the centerline of Highland Avenue, to the center line of South Meridian Street; thence north, along the center line of South Meridian Street, to the CSX Transportation Railroad; thence northwesterly, along the center line of the CSX Transportation Railroad, to the center line of Southwest First Street; thence north, along the center line of Southwest and Northwest First Street, to the center line of Apraw Road; thence southeasterly, along the center line of Apraw Road, to the center line of Jersey Street; thence north, along the center line of Jersey Street, to the center line of Viola Avenue; thence north to the north corporate boundary line; thence east, along the corporate boundary line, and the north line of Steepway Addition, to the northeast corner of Steepway Addition, and the west line of a 26.84 acre tract of land, presently or previously owned by Don F. Gress and Linda M. Gress by Warranty Deed dated July 18, 1989, as recorded in Deed Record Book 141, page 183 in the Daviess County Recorder's Office; thence north, along the corporate boundary line and the west line of the Gress tract, to the northwest corner of the Gress tract; thence east, along the corporate boundary line and the north line of the Gress tract, to the northeast corner of the Gress tract; thence south, along the corporate boundary line and the east line of the Gress tract, to the northwest corner of a 35.95 acre tract of land owned by Don F. Gress and Linda M. Gress by warranty deed dated July 18, 1989 as recorded in Deed Record Book 141, page 183; thence east, along the corporate boundary line and the north line of the Gress tract, to the northeast corner of the Gress tract; thence south, along the corporate boundary line and the east line of the Gress tract to a corner of the Gress tract; thence east, along the corporate boundary line, to the northwest corner of a 5.00 acre tract of land, presently or previously, owned by Thomas S. District 2 consists of a portion of Precinct 6, Precinct 7 and a portion of Precinct 12.
      (3)   District 3.
Beginning on the north corporate boundary line of the City of Washington at a point located 300 feet west of N.W. Sixteenth Street and running then south on the corporate boundary line to the center line of Maxwell Avenue; thence east, along the center line of Maxwell Avenue, to the center line of Northwest Sixteenth Street; thence south, along the center line of Northwest Sixteenth Street, to the center line of North Street; thence east, along the center line of North Street, to the center line of Northwest Twelfth Street; thence south, along the center line of Northwest Twelfth Street, to the center line of West Main Street; then east on the center line of the street to the center line of S.W. Tenth Street; then south on the center line of the street to the center line of the CSX Transportation Railroad; then east on the center line of the railroad to the center line of the S.W. First Street; then north on the center line of S.W. and N.W. First Street to the center line of Apraw Road; then southeasterly on the center line of Apraw Road to the center line of Jersey Street; then north on the center line of the street to the center line of Viola Avenue; then north to the north corporate boundary line; then west on the corporate boundary line to the east right-of-way line of an alley in Tieman's Addition, which point is 10 feet east of the northeast corner Lot Numbered 10 in the addition; then west on the corporate boundary line 293 feet to the northwest corner of Lot Numbered 9 in the addition; then west and north on the corporate boundary line to a point located approximately 890 feet east of the east right-of-way line of Edwardsport Road; then west on the corporate boundary line to the east right-of-way line of the road; then west on the corporate boundary line approximately 20 feet to a point in Edwardsport Road on the east line of Location 257, Township 3 North, Range 7 West; then north on the corporate boundary line and the east line of Location 257 to the northeast corner of the Washington Community Schools, Inc. sports facility; then on the corporate boundary line the following 9 courses: (1) west to the northwest corner of the sports facility, (2) south to the southwest corner of the sports facility and the northwest corner of the Washington Community Sports Complex, (3) south approximately 154 feet, (4) east approximately 79 feet, (5) south approximately 686 feet to the southwest corner of the Washington Community Sports Complex, (6) south to the north right-of way line Wykoff Lane, (7) west on the right-of-way line to the point located 300 feet east of the east right-of-way line of northwest Sixteenth Street, (8) north parallel with the east right-of-way line of the street to the section line between Sections 21 and 28, Township 3 north, Range 7 west, (9) west 640 feet to the point of beginning. District 3 consists of Precincts 8, 9 and a portion of Precinct 10.

   (C)   The corporate boundaries of the city shall comprehend and define the Councilmanic district from which 2 Councilmembers at large shall be elected.
