9-5-1: PURPOSE:
The vast majority of land in Washington County is managed by a Federal or State agency. Ever since initial settlement of Washington County lands, owners of private land and of private property interest have, of necessity, asserted and used rights of way upon and across such federally managed and State managed lands in order to obtain that beneficial and economically efficient use of their private land and property interests which is vital to the commerce and economic stability of Washington County. The purpose of this Chapter is to promote and foster commerce and economic stability within the County by authorizing the County Recorder to receive and record assertions of such rights of way upon and across federally managed and State managed lands.
