§ 75.02 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BICYCLE. Every device, other than a tricycle designed solely for use as a play vehicle by a child, propelled solely by human power upon which any person may ride having either two tandem wheels, or one wheel in the front and two wheels in the rear, any of which is more than 14 inches in diameter.
   FMVSS. “Federal Motor Vehicle Safety Standards”.
   MANUFACTURER. Any person engaged in the manufacturing or assembling of motorized bicycles or motorized bicycle equipment, including any person importing motorized bicycles or motorized bicycle equipment for sale or resale.
   MOPED. The same as motorized bicycle, and may be used interchangeably with motorized bicycle.
   MOTORCYCLE. Every motor vehicle, other than a tractor, having a saddle for the use of the operator and designed to travel on not more than three wheels in contact with the ground, including, but not limited to, motor vehicles known as “motor-driven cycle,” “motor scooter”, or “motorcycle” without regard to weight or brake horsepower.
   MOTORIZED BICYCLE EQUIPMENT. Any system, part, or component of a motorized bicycle as originally manufactured or any similar part or component manufactured or sold for replacement or improvement of such system, part or component or as an accessory or addition to the motorized bicycle.
   MOTORIZED BICYCLE OPERATOR or DRIVER. Every person who drives or is in actual physical control of the motorized bicycle.
   MOTORIZED BICYCLE. Any vehicle having either two tandem wheels or one wheel in the front and two wheels in the rear, that is capable of being pedaled and is equipped with a helper motor of not more than 50 cubic centimeters piston displacement which produces no more than one brake horsepower and is capable of propelling the vehicle at a speed of no greater than 20 miles per hour on a level surface.
   PERSON. Every natural person, firm, copartnership, association, or corporation.
   SKATEBOARD. Every device, other than a bicycle or tricycle, designed solely for use as a play vehicle by a person, propelled solely by human power upon which any person may ride or coast having a minimum of four wheels.
   SNOWMOBILE. Any self-propelled vehicle designed primarily for use on snow or ice, and steered by skis, runners, or caterpillar treads.
