§ 132.09 CURFEW.
   (A)   No adult person having the control and custody of or being the parent or guardian of a minor under the age of 18 years shall knowingly permit such minor to, nor shall such minor be upon the public sidewalks, parks, playgrounds, streets, highways or other public places between 10:30 p.m. and 5:00 a.m. the following day. This section does not apply when the minor is accompanied by his parent, guardian or other adult person having the care and custody of the minor; when the minor is upon an emergency errand or legitimate business directed by his parent, guardian or other adult having the care and custody of the minor; or when the minor is going home from special school, city, county or church activities.
   (B)   The parent, guardian or person having the legal custody and control of any child violating this section shall be subject to the following penalty. Upon the first violation of this section, the parent or legal guardian of the child shall be warned by the proper officer and the child shall be taken home. Upon the second or a subsequent violation of this section, the parent or legal custodian of the child is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
   (C)   Any minor found violating this section is guilty of a curfew violation, a minor misdemeanor.
