(A) An industrial user shall not allow the intentional diversion of wastestreams from any portion of their treatment facility if such a diversion would cause pretreatment standards or requirements to be violated. If the industrial user knows in advance that there is a need for a bypass to occur, a prior notice of at least ten working days shall be given the control authority.
(B) In the event of an unanticipated bypass that exceeds applicable pretreatment standards, an oral notice shall be submitted to the control authority within 24 hours of the industrial user becoming aware of the bypass. If required by the control authority a written report shall follow in five days.
(C) Enforcement action may be taken against the industrial user unless the bypass was unavoidable to prevent loss of life, personal injury, or severe property damage, and there were not feasible alternatives to the bypass. Enforcement action will be waived provided proper notice of anticipated bypassing was submitted to the control authority.
