§ 150.41  ORDINANCE TO CONSTRUCT.
   (A)   Whenever it may become necessary to construct any new sidewalk, the President and Board of Trustees shall by ordinance provide for the building of the same, which ordinance shall define the location of such proposed sidewalk, prescribe its width, the materials of which it shall be constructed, the manner of its construction, and what officer or officers of the village shall approve and accept the same when completed. Said ordinance shall be published as required by law for other ordinances of the village, and said ordinance shall provide whether or not the owners of the lots or parcels of land touching the line of said proposed sidewalk shall build the same in front of their respective lots or parcels, or whether the whole or any part of the cost of constructing said sidewalk shall be by special taxation of the lots or parcels of land touching upon the line of said proposed sidewalk. And said ordinance shall provide that part of the cost of constructing said sidewalk, if any, shall be paid by the village.
   (B)   If said sidewalk is to be constructed by the owners of lots or parcels of land touching upon the line of such sidewalk in front of their respective lots or parcels in accordance with the specifications of said ordinance within 30 days after the publication of said ordinance, and shall provide that in default thereof, the materials shall be furnished, and the sidewalk shall be constructed by the village and the costs, or such part thereof as may be fixed in said ordinance, shall be collected from the respective owners of such lots or parcels of land as provided by law.
