(A) Any person who violates or assists in the violations of any provision of this chapter shall be deemed to have committed a petty offense and shall be fined for each such violation. Each day on which, or during which, a violation occurs shall constitute a separate offense. For purposes of this section the 12-month period is defined on a rolling basis looking back 12 months from the date of the violation. The 12-month period is not defined by a calendar year.
(B) (1) The first violation of this chapter shall be punishable by a fine of no less than $250 and no more than $750.
(2) The second violation of this chapter by the same responsible person within a 12-month period shall be punishable by a fine of no less than $500 and no more than $750.
(3) The third or subsequent violation of this chapter by the same responsible person within a 12-month period shall be punishable by a fine of no less than $750.
