(A) Any person that operates a golf cart/ATV/UTV on the village streets shall register the golf cart/ATV/UTV with, and apply for and obtain a permit form, the Village Chief of Police or his or her designee prior to operation of the vehicle on village streets, and shall further be required to re-register the golf cart/ATV/UTV and re-apply for and obtain a separate permit prior to each successive 12-month period thereafter. The golf cart/ATV/UTV shall be subject to inspection and approval by the Village Chief of Police or his or her designee. The cost of the annual permit shall be $25. Proof of liability insurance shall be presented when the vehicle is registered.
(B) The village shall provide the permit application form and all information requested shall be fully and truthfully provided by the applicant. Any information or documentation provided by the applicant which, in the sole discretion of the Police Chief or his or her designee, shall be found to be false or deceptive, shall in and of itself constitute grounds for the denial of an application or immediate revocation of any previously issued permit. The permit application shall be substantially in the form which is attached as Exhibit A and shall require the application to provide the following information:
(1) Name and address of the applicant;
(2) A copy of a valid driver’s license of the applicant which shall be placed and kept in the village’s file;
(3) The serial number, make, model, and description of the golf cart/ATV/UTV;
(4) Proof satisfactory to the Village Police Chief or his or her designee of the name of the liability insurance carrier specifically insuring the golf cart/ATV/UTV and the policy number demonstrating compliance with the Illinois Motor Vehicle Code. A copy of the insurance card or other written indicia confirming satisfactory coverage shall be placed and kept in the village’s file; and
(5) A signed waiver of liability by the applicant releasing the village, jointly and severally, from any and all future claims by the applicant or other persons or entities arising from or resulting in any way, directly or indirectly, from the operation of the applicant’s golf cart/ATV/UTV on the streets of the village. A copy of the signed waiver of liability form shall be placed and kept in the village’s file.
(C) A copy of the proposed waiver of liability form is attached in Exhibit B. A permit shall only be issued in the event all of the following requirements are met:
(1) The golf cart/ATV/UTV passes inspection by the Village Chief of Police or his or her designee to ensure that the vehicle is safe to operate on the village streets and meets all the requirements of this subchapter and the Illinois Motor Vehicle Code;
(2) The applicant provides proof of insurance as set forth in this subchapter;
(3) The signed waiver of liability form is delivered by the applicant; and
(4) In the event that the applicant is physically handicapped, the applicant must present to the Village Police Chief or his or her designee a written certificate signed by a physician purporting to be currently licensed to practice medicine in the state reflecting the physician’s opinion that the handicapped applicant is able to safely operate the approved golf cart/ATV/UTV on village streets.
(D) The Village Chief of Police or his or her designee may suspend or revoke any permit previously issued upon a determination made in the sole discretion of the Village Chief of Police or his or her designee that:
(1) The permit holder has previously provided false or deceptive information or documentation during any prior application process;
(2) The permit holder is no longer capable or otherwise cannot safely operate an approved golf cart/ATV/UTV on village streets; or
(3) The permit holder or golf cart/ATV/UTV no longer meets any or all of the application or permit requirements as set forth hereinabove.
