(A) Every residential household and business in the city shall make arrangements to provide for solid waste collection service with a collector licensed under Ch. 118 of this code of ordinances.
(B) A residential household or business may request exemption from the requirements in division (A) above by demonstrating to the Records Administrative Secretary that the household or business has an environmentally sound alternative to contracting with a solid waste collection service.
(C) It shall be unlawful for a residential household or business in the city to violate division (A) above after receipt of written notification from the Records Administrative Secretary of violation and failure to make arrangements for solid waste collection service within 30 days after the written notice of violation or failure to obtain an exemption pursuant to division (A) above.
(D) The Records Administrative Secretary shall annually do a random sampling of at least 10% of households and residences, or upon complaint do an investigation, to ensure compliance with the requirements of division (A) above. For purposes of compliance with division (A) above, proof of compliance would include providing the name and address of a solid waste collection service with which the residential household or business has a contract. The Records Administrative Secretary shall further conduct a random sampling to confirm the existence of contractual arrangement with solid waste collection services. Proof of compliance with division (A) above shall also include proof of purchase of bags used by a solid waste collection service and/or confirmation from a solid waste collection service that the bags are picked up from the residential household of business.
