§ 31.06 FIRE DEPARTMENT.
   (A)   The Fire Department is hereby established. The department head shall be the Chief of the Fire Department.
   (B)   The size and composition (including, but not limited to a determination as to permanent and volunteer members shall be established the city, which may be changed from time to time. The Council shall also establish, upon the recommendation of the City Manager, written rules and regulations of the Department including its internal structural organization, a copy of which shall be distributed to each of its members. The Chief of the Fire Department shall have general superintendence of the Fire Department and the custody of all property used and maintained for the purposes of the Department. He or she shall see that the same are kept in proper order and that all rules and regulations and all provisions of the laws of the state and ordinances of the city relative to the Fire Department and to prevention and extinguishment of fires are duly observed. He or she shall superintend the preservation of all property endangered by fire and shall control and direct all persons engaged in preserving the property. In case of the absence or disability of the Chief for any cause, the Assistant Chief shall exercise all powers, perform all the duties and be subject to all of the responsibilities of the Chief.
