The staff of the Department shall be granted and allowed immediate access to any premises upon which a spill has occurred. The Department shall determine whether timely and appropriate actions have been initiated to contain and clean up the spill. If such actions and activities have not been initiated, the Department shall assume responsibility for the containment and cleanup activities. The Department shall be immediately allowed access to any premises upon which the Director, in its sole and absolute discretion, has determined there to be a need for cleanup activity.
