4-7-2: APPLICATION FORM, MEDICAL INFORMATION AND AFFIDAVIT:
In conjunction with a request for PSEBA benefits, the public safety employee, or his/her representative, shall file a completed application for PSEBA benefits, relevant medical information and an affidavit for PSEBA coverage with the city administrator within ninety (90) days of the employee or family members of an injured public safety employee being granted a line of duty related pension or within ninety (90) days of the public safety employee's death. The application for PSEBA benefits shall include, but shall not be limited to, a fully detailed statement of the nature of the employee's claim giving full particulars thereof, i.e., date, time, place, nature of injury, and any other factual circumstances surrounding said incident giving rise to said claim.
Within twenty (20) days after receipt of the aforesaid PSEBA information, the city administrator shall determine whether sufficient documentation has been presented to warrant approval of the requested PSEBA benefit. Should the city administrator:
   A.   Approve the PSEBA benefit, then that written decision shall be deemed a final administrative decision; or
   B.   Need further information, then the city administrator shall send notice of that determination to the applicant. The city administrator shall notify the applicant of the date, time and location of a fact finding hearing for the purpose of additional information gathering; or
   C.   Deny the PSEBA benefit, then the city administrator shall send notice of that determination to the applicant by certified mail return receipt requested. The applicant shall have the right to request an administrative hearing (the "PSEBA administrative hearing"), in order to contest the denial, which request must be filed with the city administrator within thirty (30) days after the mailing of the denial letter. Upon receipt of such request by the applicant, the city administrator shall notify the applicant of the date, time and location of the PSEBA administrative hearing to contest the denial. At the conclusion of the PSEBA administrative hearing, the city administrator shall send a copy of the hearing officer's decision, which shall be deemed a final administrative decision, to the applicant by certified mail return receipt requested.
