4-4-12: ANIMAL NUISANCE PROHIBITED:
It shall be illegal for any person having control, custody or ownership of an animal to allow an animal nuisance. The term "animal nuisance" shall include:
   A.   An animal which, because of noise, odor, disease or other unwholesome factors, is offensive, harmful or injurious to the public health, comfort or welfare;
   B.   The accumulation of animal feces or other animal waste in any yard, pen or premises in or upon which an animal shall be confined; (Ord. 1169, 7-15-1991)
   C.   The failure of any person having custody, control or ownership of an animal to remove feces deposited by said animal, except guide dogs, upon the public ways or within the public places of the City, or upon the premises of any person other than the owner without the person's consent;
   D.   A vicious or dangerous dog that is not kept, harbored, maintained, owned or possessed within the corporate limits of the City in strict conformance with the provisions of this chapter; or (Ord. 1301, 3-7-1994)
   E.   A domestic animal that is off the property of its owner unless it is under the direct control of a person physically capable of controlling the animal. (Ord. 2108, 12-15-2003)
   F.   Notwithstanding any provision contained in this chapter to the contrary, K-9 and guide dogs shall be exempt from the provisions of this section. (Ord. 1301, 3-7-1994; amd. Ord. 2108, 12-15-2003)
