4-3-18: VIDEO GAMING AND SWEEPSTAKES MACHINES PROHIBITED:
   A.   Video gaming: Video gaming and video gaming terminals, as each are defined in the Illinois Video Gaming Act, 230 ILCS 40/1 et seq., as amended, are hereby prohibited within the corporate boundaries of the City of Warrenville, Illinois except in accordance with the Illinois Video Gaming Act, as amended, and pursuant to a video gaming terminal license, pursuant to and in accordance with Chapter 3 of Title 3 of this Code, and a Class V liquor license, pursuant to and in accordance with Chapter 2 of Title 3 of this Code.
   B.   Sweepstakes machines:
      1.   For purposes of this section, “sweepstakes machines” are defined as any standalone, tabletop, or similar mechanically, electrically or electronically operated device or machine in which a participant is automatically entered into a sweepstakes or similar promotion for cash or merchandise as a prize wherein the participant has the option to reveal the results of entry into said sweepstakes or promotion via an entertaining display mimicking or simulating slot machines, poker, keno, bingo, any other game the outcome of which is not in whole or in part dependent on the skill or dexterity of the participant, or any form of a printed ticket or otherwise. Any such device or machine shall be considered a sweepstakes machine regardless of whether consideration is paid to obtain entry into the sweepstakes or whether a coupon for a product or service is provided in exchange for consideration.
      2.   It shall be unlawful for any person to operate, place into operation, or allow the operation of a sweepstakes machine within the corporate boundaries of the City of Warrenville, Illinois unless the operation of the sweepstakes machine satisfies the requirements for the legal operation of a video gaming terminal as set forth in Subsection A of this Section. Nothing in this Subsection B shall be construed as prohibiting video gaming as otherwise authorized in accordance with Subsection A of this Section.
   C.   Any person convicted of any violation of the provisions of this section shall be fined not less than five hundred dollars ($500.00) nor more than seven hundred fifty dollars ($750.00) for each such offense. (Ord. 2548, 11-2-2009; amd. Ord. O2021-34, 9-7-2021; amd. Ord. O2022-22, 7-5-2022)
